Occupational rent
<p>I signed for purchase of a Balwin development unit in March 2016, scheduled move in date June 2016. However every month since I have moved in, they have been promising to register us with the deeds office - we are now on month 4, going onto month 5 to pay occupational rent.</p> <p>When I had asked Balwin and the attorneys "Tonkin Clacey attorneys" what is taking so long to get us registered, their responses are vague "apparently waiting documentation from the council" and no response at all from Balwin themselves. When I had refused to pay last months occupational rent - I was issued a letter of demand for payment, but still no communication as to why we have not been registered, just the simple fact that they were going to take legal action as we are bound by contract.</p> <p>I believe they are delaying on the registration because not all the units in the phase has been sold at this stage (empty units), they have even tried to make sales by providing people whom buy now with R20000 vouchers to make up for the occupational rent. I however dont believe for someone that came early to purchase in the 1st phase, should now be paying the same as later phases. How long is this going going to go on for, as every month it is promised 'next month'.</p> <p> </p> <p>Apparently this has happened in a few more complexes they have built, but it is not their first time - so surely they know how long it would take. I am now waiting 7 months since I have signed for purchase.</p>

Kindly be advised that we note your concern and we are fully aware of the delay. Balwin properties is definitely not delaying the registration and we are working with the council on a daily basis to obtain the required documentation to allow lodgement to take place.
The R20 000 vouchers is purely a marketing campaign that we are currently running on a selected number of developments, being Malakite and Greenstone Crest. This marketing campaign has been run at other developments previously.
It is our intention to lodge immediately, once the required documentation is available to us from council.
We apologise for the delay in registration and understand your frustration with this process.
Please be assured that we are doing everything possible we can to resolve this matter as quickly as possible.

I still feel that this response is VERY vague.
Please could you advise what documents are outstanding from the council, and what is causing the delay of these documents being handed over (Im assuming you are aware of the reasons since you are working with the council on a daily basis as advised above)? I believe their turnaround time to be 6 -8 weeks, we are now going into month 5 of occupational rent nevermind the time before we had moved in.
What is the target date for the registration? Malakite is one of the smaller complexes out of all your dproperties therefore from your past registrations it should be moving at the same pace if not quicker.
