No Refund Despite item not meeting need as per CPA

Today my father went to BabyCity in Springfield so he could buy a plastic change mat cover for his granddaughter. He asked staff for advice and they told him they didnt stock but advised that he take a material change cover mat which had a plastic sheet backing. Not able to open the package, he took staffs advice and bought the item only to discover that it was the wrong size. My father promptly returned it within 30 minutes and was told that it was their policy not to refund and insisted that he take a gift card. According to the CPA : Goods do not meet particular purpose.<br> <br> In terms of s55(3) (read with s20) of the CPA, if a consumer informs a supplier that the goods are being bought to fufill a particular purpose, and the suppliers advises that the goods will meet this particular purpose then:<br> 10 days after receiving the goods<br> the consumer can return the goods if it is not suitable for the particular purpose<br> the consumer can cancel without penalty, and<br> the supplier is liable for the costs of returning the goods<br> <br> Its obvious my father was advised incorrectly. Correct this situation or i will forward to the consumer watchdog and social media! Dont take advantage of the elderly!!!
