NIGHTMARE EXPERIENCE

In a nutshell, Ayoba's CEO and sole director, Michaell Brand, blatantly **** to me to entice me to pay him in advance for a small renovation and building project. In his own words the project should have been a 6 to 8 week project but has now been going for close to 5 months and there is no end in sight. I was told that if I pay him in advance, he will finalise the project on an expedited basis. He gladly took all my money but has no interest in finishing the project, despite a formal letter of demand having been issued and received by him. The lies do not stop with timing and the money, he also **** amongst others about products, the quality of products and about an engineer. A written report by a very well respected structural engineer refers to Ayoba's work as "shoddy to say the least" and "hopelessly inadequate" and "failed dismally". Despite the engineer's urgent requests for Michaell Brand to provide him with engineer drawings and certifications, he has not done so. Ayoba's Michaell Brand has **** repeatedly and has delivered poor workmanship and poor quality products. It has been a nightmare dealing with Ayoba and Michaell Brand and there is no end in sight as no proper effort is being made to finalise a project for which I have paid in full. Ayoba's worker/s also stole cash from a drawer while I was at work. Michaell Brand said he will replace the money but has never done so. This project has been the worst nightmare of my life and, despite having paid in full, there is no end in sight.

From the outset we would like to make it very that we vehemently deny the allegations contained in the report by the Complainant.

To address certain points directly we respond as follow:

1) Blatant lie:

a. I never **** to the clients;
b. A progress payment schedule was put into place. Meaning that certain progress had to be made prior to a specific payment being made;
c. Certain payments were requested for tasks that were performed ahead of schedule, meaning that a partial payment for partial completion of the progress was requested.
d. On two occasions I requested earlier payments, on both these occasions it was for the sole purpose of securing labour and material on site earlier in order for us to meet deadlines.
e. The complainant fail to mention the various items I supp**** free of charge, being the skylight, single trellidoor and other minor items.


2)Project time frame:

a. The initial timeframe was an estimation of 6 to 8 weeks. This was prior to being on site and we were instructed to demolish the pond and extra work was pointed out.
b. The timeframe was updated to 12 weeks and reflected as same in the contract.
c. The complainant fails to mention the various variations he requested, which adds a significant of time, as well as the time it took to do the remedial work as suggested by the engineer.


3)Letter of demand:

a. At no point in time did we advise the complainant that we would not complete the project.


4)Quality of products:

a. the building products we use are SABS approved;
b. The skirtings and cornices are SABS and SANS approved;
c. The paint is SABS and SANS approved;
d. The taps and shower fittings are TIVOLI;
e. The built in cupboards are powder coated solid wood with above average hinge mechanisms.
f. It is submitted that the products used during the construction period is of superior quality.


5)Engineering and poor workmanship:

a. I enquired from the engineer regarding what work specifically was referred to and was advised that it was a certain piece which was not done by Ayoba Projects but rather by a specialist roofing contractor.
b. The engineer advised that a water outlet on the small slab was inadequate for the amount of water it would have to channel.
c. The engineer advised that the balance of the work is as per normal building practice.
d. Furthermore I consulted with an engineer on various occasions and an engineer signed off on the foundations.

All the various engineering reports and certificates are on file for insurance purposes.


6)****** money:

a. It is alleged by the complainant that money was ****** out of their house, our staff and us were accused of *****ing same however the complainant fails to take into account the various people moving through the site including but not limited to our staff, contractors, suppliers and complainants’ own staff.
b. In an attempt to repair the situation we insisted on paying the amount back to the complainants, it was agreed that same will be deducted from the retention amount.


7)It is our submission all the relevant information was not supp**** to portray the true nature of the situation.

The official response above is very amusing but at the same time it is also extremely worrying. I met with the other complainant on this site and it is alarming to note the similarities between my horrible experience with Michaell Brand and Ayoba and what the other complainant experienced with them. In both our experiences the lies do not end and it is just continuing. The public should do themselves a favour and also read the other complaint on this site to ensure that they do not fall into the same trap that we did. This is in the public's interest and the exact reason why I decided to post my complaint. We suffered severe financial damage and emotional distress. I have an independent report from an inspector from Inspect a Home, an engineers report, various witnesses, photos, recordings and invoices and payment confirmations (from other contractors who fixed the mess) to back my complaint. The obvious questions remain: where is the money that I paid in advance and why is it not repaid to me? Where are the goods/ items that were promised to me and showed to me in brochures or pictures, all for which was paid for by me? How is it possible not to finalise such a simple project in more than 5 months after being paid in full in advance? Why on earth would I pay other contractors to fix a mess that didn't/ doesn't exist and to complete the simple project ? Why would Ayoba not pay the penalties,signed and agreed to in writing by Ayoba and Michaell Brand? My failure to respond to each allegation is not, and should not be construed, as an acceptance thereof. The submissions and contentions herein are not exhaustive of all my submissions and contentions , which will be raised in the appropriate forum at the appropriate time.
