Paying for pre existing damage, why

Why should i pay for preexisting damages on the car rental just because the check list was not done properly..... This is frustrating and terrible. Where can i complain or dispute the bill? I've been phoning them but i don't get clear instructions on how to dispute. This is against the CPA
