Avis Rental Agreement Dispute - *** & ***

On the 24 March 2017, at 08:24, my family rented a car from Avis Port Elizabeth Airport, in my name. The WHI RAV 4, Registration CS 369077. We did the pre-rental inspection of the car and found that the parcel tray clip broken T bumper(s). Grant and myself signed for this. On the 27 March 2017, at 12:25, we returned the car and did the post-rental inspection with Siviwe. He said all was fine and he was happy - you are free to go. Our flight was at 14:00 so we checked in, glad to be nice and early. At about 45 later, I get a call from Siviwe and he says the car's windscreen has a crack. I got puzzled and ask him when did he discover this because we were all there when the inspection was done. He said he saw it just now that is why he calls. I asked him where is the car now and he said it was where we had left it on the returns lane. I told him that was not true, he must tell his Superiors what he has done with the car and not lie and pick on the soft target to smear the blame on. My family was just as shocked and I quickly decided to ask the boarding gates Security to allow me to go back to Avis and sort out this mess. I approached the Coloured lady who had assisted us with the rental on the 24 March. Thank God she was on duty again today. I explained to her what just happened and she was shocked and came out with me to the back to see the cracked windscreen. The car was not there where we had parked it and where the inspection took place. She tried to call him but he didn't answer. Our conclusion was, clearly, Siviwe drove the car and did whatever that caused the crack and decided to shift the blame. She said she will handle the enquiry and I should go back so as not to miss my flight. On the 29 March 2017, I receive a refund of R3775 from Avis from the R4000 which I transfered for the rental in Port Elizabeth. On the 18 April 2017, I get call from Avis PE regards the allegations about the car we rented. I explained to this guy (whose name I missed) all over again the developments of that fateful day. He said he was going to check internally what is going on and will revert to me. Two days later on the 20 April, Avis debits my bank account with +-R9000.00 Please note that, there is nothing in writing between myself and Avis, to state the charges/allegations on paper. I called my banker to enquire about the transaction. After listening to her explanation, I told her my side of the story and I asked her to reverse the entry and she did. Two days later, Avis debits my account again with R3775.00. There is still no written correspondence from Avis. I call my banker again on the 25 April, to reverse the transaction and she sends me a Dispute and Outstanding Reversal Request form to complete, sign and return so that she can contact Avis in this regard, which I comply with. Then beginning of May, Avis instructs some company called Credid Works to chase me for the money because I stopped using my account and their collection order remains unpaid. Credit Works has failed to send me records of my contract, legal letters of sorts and the court order. They keep on harassing me by calling me 2x daily, after hours and on weekends. On the 20 July, my Sister and I decided to go to Avis Head Office at OR Tambo to report this whole incident again because my Sister had done so in May. The lady that assisted us promised that this matter will be handled and sorted by HO. To this day, I have not head from them. Credit Works still continues to harass me and my credit record and status has been compromised and damaged at the bank. Peter and Team please intervene and fight for us the small people from capture by irresponsible staff of Avis. I want Avis to remove that debit order, pay for all charges and costs for unpaid debits and to ensure that my account is restored to its credible status. I look forward to your assistance as soon as possible.
