AVIS - Charging damages to client ********ly!

I have rented a vehicle in Cape Town and upon inspecting the vehicle there was a damage on the rear right bumper when informed the inspector that was doing the inspection with me had verified that it was noted upon returning the vehicle was told that the damage will be for my account and was taken off my deposit from my credit card and upon numerous emails they have not yet credited me for the damages that was not committed by myself.

Good day,

How can the charges be deemed to be correct when the damage was not caused by myself??

I have a trail of emails as proof that they are still looking into the matter.

So Avis will be keeping my money for damages that was not caused by myself?

Good Day Muhammed,

Please advise if you have been provided the pictures of the damage? Yes the damage may have not been caused directly by you. However due to the vehicle being your possession, it does become your responsibility.

Good day,

No I have not been provided with the pictures.

I don't think you understood the first time the damages were there upon inspection before the vehicle was taken into my possession and the inspector had advised that the damages were already noted so how can it be my responsibility for damages that were already there?

Please advise.
