Avis Car Hire Mini Lease

I started a mini lease with Avis Car Hire on about the 5th of October this year. The original lease were signed for 3 months. Avis Pinetown, where I collected my vehicle from, swiped my cheque card for a holding deposit of R12000.00 and I received the message on my cellphone telling me it was successful.

I was under the impression that the payment for my first months rental plus extra incase i use extra milage, etc. has been sorted and off i went.

On 10 November 2016 my cheque account was Debited with an amount of R8109.00 by Avis, pushing my account into overdraft with that amount! I was under the impression that it was my November rental that went off but decided to make contact with Avis Pinetown to confirm all is in order. Upon talking to them, they told me that it was in fact only my first months rental that they took and that they cannot swipe my cheque card to secure the new months rental. Wish is quite understandable because my cheque card was sitting on a negative balance of R8109.00! When I asked the consultant at the Pinetown branch what happened to the holding deposit of R12000.00 that they originally secured, he told me that it would have been released to my account after they took the debit for the first month. I was in utter shock, as no money went back into my account. When I told the consultant this, he told me that i wont be able to see the transaction on my bank statement. My argument to him was that surely Avis secured the money in the first place to ensure that when they do enventually do the actual debit on my account, the money was secured and available. No one in Pinetown could tell me why this happened. When I told the Pinetown consultant that I have the cash available to pay for my next months rent, he told me that they are not interested in cash they just want to swipe my card again. I told him that thanks to Avis, my account is sitting in overdraft and that if I have to deposit the money that i secured for the new months rental into my account, it will only cover the current overdraft that they created. I called the Avis call centre with not mush luck. I had to email my details and a consultant will call me back within 24 hours. In the meantime a guy by the name of Eugene van Tonder started calling me informing me that he was informed by Avis that he must collect the car. I told him that it is cefinately not going to happen as Avis took R12000. security on my account that they allowed to lapse prior to taking the debit resulting in my cheque accpount being in overdraft. Not only have they created a bad credit record on my cheque account, I also sit with double an installment to pay that I did not budget for.

I eventually handed this matter over to my attorney to resolve.
