Avarca avenue SA - dismal service
<p>The service from Mohammed at Avarca South Africa was dismal. Avarca has reneged on their promise to me, and it is for this reason that I write this complaint.</p> <p> </p> <p>After ordering a shoe online, we received this email from Avarca (Sent: 07 September 2016 02:20 PM)</p> <p>"We received your online order. We just wanted to notify you that the Squama Sand in a size 40 that we had in stock was from the old stock, therefore it looks different to the size 37 as it came different this time."</p> <p>We advised on email to stop the order. Avarca rep**** that the order was already dispatched and stated in an email "Should you insist on a refund, you will have to arrange to send it back to us yourself."</p> <p>Upon delivery, the colour was significantly different to the picture online. When I requested the refund/exchange :</p> <p>Avaraca rep**** on 11 Sept "That is the picture provided by our supplier and that is the item we received. What I spoke about being different is the new completely beige batch that was received. Our supplier is based in Spain. All products are imported and due to their leathers differing from time to time, the shoes are subject to differ slightly from time to time. We cannot be held responsible for what is sent to us, hence our no refund and exchange policy."</p> <p>I then advised Avarca that their no returns/no exchanges policy is in breach of the Consumer Protection Act.</p> <p>Avarca's response dated 13 September reads as follows: "As stated in our email of 11th instant, we intend on seeking advice from our legal advisors. We cannot fathom as to how this step on our part is "resisting compliance with the Consumer Protection Act 68 of 2008". No reasonable person would have a chance to seek same between 4:00pm and 9:00pm on a Sunday. Be that as it may, you are more than welcome to publicly demonstrate what you want and go to a court of law for an item that is less than R1000.00 with no visible or actual defect. We ourselves do not see a difference between the two items below. <br />You speak of quality, yet the quality of our item is still impeccable. A court of law will only take your claim seriously if there was a manufacture default, which there is not. <br />Due to your constant harassment, threats, impatience and refusal to allow us to seek proper advice, we no longer wish to do business with you. Kindly refrain from contacting us or we will have to get a restraining order against you. "</p> <p>My reply is as follows:<br />"I am merely holding you accountable to your own words wherein you said : " Should you insist on a refund, you will have to arrange to send it back to us yourself"<br />I am not harassing you as I feel aggrieved by you ridiculing me over the phone. I told you to stop my order on email and you rep**** and said it was already dispatched and "Should you insist on a refund, you will have to arrange to send it back to us yourself".</p> <p> </p> <p>I await Avarcas response.</p> <p> </p> <p> </p>
I have subsquently contacted AvarcasUSA and they confirmed that they are not in any way affiliated with Avarca Avenue. They are also aware that Avarcaavenue.com is *******y using their images.
Furthermore, after requesting an exchange, Avarca Avenue changed their policy on their homepage to "no returns/no refunds". However, they failed to change it on the product description below each item. Oops !!!!
