Failure to do refund for services not rendered

I had made a payment to Vanessa Rhyman through eft for a clown entertainment package and the payment was sent via eft to an account in her husband Zaheer Rhymans name. The job was for the 11th April 2015. She did not turn up for the function after spending the clients moneys. After finding out that her story was true I gave her a break to pay me after a month. Hence 2 and half month is gone by and she still didn't do the refund. He reason for not returning the money is that she spent it and she don't have money now. I must either wait or take her to small claims court for my refund on the job she she took money and never turned up for. In fact it was her suggestion that I complain about her on hello peter becos she has such bad attitude with other peoples money. She makes her daughter chat on behalf of her saying all funny things when the rightful thing to do is, if you take someone's money and don't turn up for the job, you need to give the money back.
