HORRIBLE EXPERIENCE - Lies - Manipulations - SHEER ARROGANCE I regret the day I gave them my car to mange in 2019. This vehicle is still under finance, and was given to the first user who wrecked it, acording their own account. Though their contract stipulates that the user will repair the vehicle to the condition he/she received, they claim that they went on to repair the damages, got the vehicle back on the road and advertised it. When they wanted to give it to next user, I objected, and was told that they wanted to get their repairs money back. The second user had mechanical issues almost immediately because they use foreign mechanic working from the backyard, not Audi as I would always do. I vehemently objected to sign the contract for the 3rd user as they have changed the terms of the contract on their own without my consent since the vehicle was paid in advance. Upon my objection was told that I will need to pay back the deposit to the user, R45 000.00, which I was not even told anything about. The 3rd user took delivery of the vehicle around December 2021, he also had issues with the vehicle and returned it to them in March 2022. In May 2022, Autgroup only informed me that the user have returned the vehicle due mechanical issue, and asked if I still wanted it back and I said yes, I wanted it back, because I felt that my stress of working with them was over. They have raised the clause that says 'the owner agrees that should the vehicle be REPOSSESSED from the USER for any reason other than the breach by the user, the owner will repay all the monies paid by the user. This is the only clause they are keeping the vehicle for, even though on their own account, they say the user returned the vehicle due mechanical issue, but if want it back, it's REPOSSESSION. My vehicle has be stripped to a point that the tracker is unable to track it, they have even taken all the wheels from the vehicle, just because they can do it. They have not been paying installments on the vehicle since abou 8+ months ago, claiming that they are recouping what they have spent on the vehicle. These people are not honest in their dealing with the smaller guys, they even condescendingly interpreting wrong just to get you to submit. Anyone who wants to give their own cars to them, BEWARE! Don't be fooled. Ask them what the Contract USE is, ask them under what circumstances can the owner get out of the contract if no longer happy, ask them what if the user returns the vehicle due mechanical issues.

Let me double up. I need Autogroup, for once to accept that they are wrong in demanding that the owner is liable to repay the user the deposit when the user returns the vehicle, this is so because the vehicle was nor repossessed by the owner and/but the owner wants back.

Unfortunately not all the facts have been provided. AutoGroup took on the management of vehicle in 2019 and on the very first day before it was handed over to the first User the vehicle presented with issues and was taken to an Audi dealership to be checked. The diagnostic report indicated an issue with the turbo. The first User did not honour the agreement however AutoGroup ensured the vehicle was collected and a new engine installed, the Owner was updated and made aware of this. No objection was made to AutoGroup repairing the vehicle, however upon completion of the work the Owner then requested the return of his vehicle. This option was not denied but the Owner needed to cover the repair costs paid out by AutoGroup. The mechanic who has worked on the vehicle is a certified BMW mechanic. The total cost of repairs carried out over the past 3 years has amounted to over R115 000.00, this does not include the upfront deposit paid to the Owner of R25 000.00 (less repairs from day of handover), the advanced payments made each month to the account by AutoGroup which put the vehicle in an advance state of over R40 000.00 and the R117 000.00 that was paid off on the vehicle.

To clarify some incorrect points stated by the Owner, the last User did return the vehicle, and the Owner was contacted, but he stipulated, he did not have the funds available to take  the vehicle back. The vehicle is currently in storage and a valid lien invoice has been drawn up, this is to ensure the correct legal recourse is taken. The vehicle has not been stripped, the battery has been disconnected as the car is standing at a repair centre. No changes have been made to the agreement since the inception. Should an Owner want their vehicle returned, the agreement has always stipulated that the deposit paid by the User needs to be refunded less a fair rental. 

And lastly when the Owner first contacted AutoGroup asking for assistance at no point was he coerced or given false information. We outlined & answered any questions or concerns he had.

Side note - AGVR has been requested by the user to return the Tyres and Battery that he put in recently as the owner does not want to pay him back his deposit. We have removed both for him. The car still stands at the workshop for the owner to sort out the monies owed and remove it. This owner is hoping that by defaming AGVR with false accusations he will force us to give him the car without him having to pay the money he owes. He has benefitted from R115k repairs, R25k deposit, R175k worth of payments and now that he realizes he can make money by selling the car for cash, he is trying to get the car back without payment. If we indeed acted **********ly or with malice, the owner would be able to open a SAPS case or involve the law and or bank yet he chooses this forum to try humiliate us into doing what he wants. We are always open to a sit down and comprise where both user and owner won't lose.

What about contractual obligation? The user returned the vehicle to Autogroup demanding his deposit back, nothing else. Autogroup wants me to repay him his deposit which they took, why? I handed the vehicle to auto group with wheels (tyres and macwheels), engine and Audi battery, now the wheels and battery are removed, who has the recourse?
Quoting the Agreement of Use: 2.1 The User will maintain the vehicle in the same condition as it was received, notwithstanding normal wear and tear, as per relevant manufacturer's specified requirements;
6. Both parties (user and owner) agree that THIS Agreement can be canceled, only if both parties agree to cancelation in writing. The person initiating the cancelation will be responsible for any/all costs as per the Agreement.
10.1.9 Costs of any extras added or MAINTANANCE carried out on the vehicle by the User during the period of usage, will not be refunded by the Broker/Agent/Owner. Should the User remove these extras from the vehicle, and vehicle needs to be repaired to bring it back to the original condition, these costs will be deducted from the initiation/deposit fee and is not refundable by the owner.
Autogroup knows I'm right, and are holding me ransom because they can. They know going to the police will be futile, since this is a contractual matter, malice is not a crime, this needs to go to court through a lawyer that needs to paid. First they reply that the vehicle is not stripped, I have sent them pictures to the effect, and then they change and say the User who sits in kzn have removed the tyres in demand of refund of putting them there, when did he remove the tyres? Who gave him permission? It's lie, and they know it, or maybe not, because the 4 macwheels are also off, not the two tyres. The user bought two tyres in January 22nd 2022, like any one who've bought a 2nd hand vehicle will do from time to time, and this is after more than a month of using the vehicle. If there's any humiliation, I am humiliating them with facts, facts as stipulated in their contract, not the compassionate rhetoric about fixing the car and amounts spent. There's not even a single point that they say I was incorrect about that holds water, I have emails that prove I was against paying back deposits that I was not party to. Again, Autogroup cannot hold clients accountable to the signed contract and then ********* them by using compassionate reasons of their 'compromises and helpfulness', they helped the 1st user by fixing the vehicle on his behalf, not me, I never asked.
I'm also open for a sit down where my interests can be objectively looked and reach a compromise.

We have stated the facts and we will not be bul**** into submission as we have a responsibility to the user as well. We said the user requested the battery and tyres back, we never said he removed them. You are twisting things to suit a narrative to try and bully us into giving you what you want and hurting the user. This we won't do. If you are correct in all the things you say, please see an attorney and SAPS. You said we committed *****? That is a ******** action not civil. Unless we didn't and it's part of your plan to try and badmouth us to giving you want you want? We called and offered a solution but you are not happy as you wouldn't score on it. It would however settle the finance company, pay back the user and put a little cash into your pocket. You however declined due to the fact that you want to make money off the car and ***** everyone else over. We will no longer respond. Our record speaks for itself. You, yourself said on a voice note that you have never had a problem with us and we did everything properly. The only time you have come up with the lies and attacks is because you want to do this without being fair to the user. You say you weren't party to deposits but you were paid one weren't you? As discussed via message, we have offered 3 different compromises, you have offered none.
