Sold a damaged car and don't want to pay for repairs, ignoring all my forms of contact
I need some legal advice. I bought a car from a dealer (Autofame, previously Auto4U) in JHB in the beginning of March 2017. I flew to JHB on the 11th of March and signed everything with the dealer and took delivery of the vehicle and drove it down to CPT later that night. As I was leaving JHB the car started giving me problems and I called Audi Assist and they advised that they can either tow the car to the nearest Audi and have it looked at on Monday (I had to be at work on Monday) or because it was only a warning light I could continue driving but if it becomes a major issue get back to them and they will arrange for towing. I managed to make it to CPT with the car and took it to Audi CPT on Monday morning and they did the repairs under motorplan and I got the car back on Thursday evening.
After collecting the car the airbag light went on and I called to book it in and was given a date a few weeks away. On the 31st of March I was informed that the financing bank wasn't able to finance the vehicle because it had previously financed it and the settlement was done by insurance. This came as a surprise to me as I had asked the salesman based on the pictures I was sent by my cousin (who viewed the car for me as I was in CPT), if the vehicle had previously been involved in an accident and he said no and even when I was collecting the car I pointed out what I was seeing in the pictures and once again was assured that the vehicle was never involved in an accident. I told them I will contact Audi SA and find out if the motorplan will not be affected by this and after a week of waiting, with the dealer, finance company and the previous owner breathing down my neck about signing the new paper with another bank, Audi confirmed that motorplan was still intact. I took the car in for the airbag light on the 24th of May and was informed that the seatbelt tensioners were physically cut and needed to be replaced and the motorplan will not be covering this as it was damage to the part and this is as a result of an accident and the repairs not done by an approved panel beater. They informed me that this could possibly affect the motorplan and there is a chance they can cancel it.
I tried contacting the dealer about this and was informed that the company has new owners (with the old employees) and is under a new name now but I am struggling to get hold of the current owner now and they aren't able to get into contact with the previous owner about this matter. The car has defects and is not what I had initially bought, given that there has been a lot that has arised after taking delivery, from the accident damage and multiple issues with the airbag light and problems with the car and the risk of motorplan being canceled, of which the motorplan is suppose to expire in 2019 Oct or 100 000km (currently on 65 000km). The motorplan was my main reason for buying an Audi so I do not have to worry about any maintenance problems I experience with the car.
Salim Mohammed the owner does not even bother getting back to my requests for him to contact me and all my calls and emails are being ignored. Their phone rings with no answer because they know it's me calling.
