No refund on damaged car

Saw a vehicle online and contacted the branch in Silverton. I had to pay a R5000 deposit. A roadworthy certificate was given. Henri Dique said that he went through the details and that there is nothing wrong with the vehicle. When the vehicle arrived it was damaged. I asked Henri what will happen if I see the car and not decide to take it. He said that the deposit will be paid back to me. After 2 weeks of constant follow ups I received a email from Henri saying they endured costs and that is why I will not receive any refunds. He also said that the 101 check was done, but obviously it was not done as there was damages on the car. Whether the deposit was R5 or R500 it is a matter of principle and business practice.
