Ungrounded, unethicle rejection of claim.

I was involved in a motor car accident with a client of Auto and General insurance group.

The accident occurred when the client overtook me at an intersection, I was in the process of turning right(Indicator signal activated long before ) off from a dual directional single carriage road when the motorcycle over took me in an intersection by coming over the solid line into oncoming traffic and hit me on my RH fender, front wheel and ripped my front bumper in 2 pieces. The road on which this occurred is Platterkloof road, the road has been under construction for a while now with no overtaking signs placed all along the road, including the intersection where the accident occurred. The driver of the motor cycle continued driving off after accident occurred, which I then caught up to him about 8km away. At the time of the accident I had my work colleague with me, whose testimony I have.

The driver clearly admitted guilt of the accident on such set day and still does, however his insurance company rejected my claim for the damages that occurred to my motor vehicle. The insurance company claims that the accident was at my fault according to “the law of collision”. I visited the law enforcement office & traffic municipal court in Atlantis and the officials that I met there went through the National road traffic regulations act and showed me on how many basis the motor cycle driver was in the wrong. I requested from the consultant at Auto & General for documentation proof that illustrates what action I performed that was against this so called "Law of collision" which declare that I was at fault, this I have not received, just some letter that states that I should be weary before overtaking.

The rejection of the claim by Auto and general I believe is unjust according to the basis of (National road traffic regulations act ) even pure general knowledge .

The damages to my motor vehicle is approx. R30 000 +, to pursue this case with a private lawyer is approx. R25 000 and takes approximately 2 years to pan out.

The company is abusing their access to legal aid as I am a uninsured motor vehicle owner with limited access to legal aid although they know they have no case to stand on, this automatically deters one of pursuing the case as the fee is high take up loads of time (2 years!!) . This is what they want, this what they do, this is what happens. Ethics and what's right means nothing.
