Third Party Liability - A TOTAL ****

On the 12th of November i was involved in an accident where the other person failed to stop at a yield sign and give right of way to on coming traffic at an intersection where i did not have a stop sign, traffic lights or any yield sign but sideways the person crossing over has a yield sign and they must stop and give way. A few seconds before the collision happened i took necessary precautions to slow down my vehicle and when i realized the person was not going to yield and stop, I swerved my vehicle to the left hand side to try and avoid the collision but it was already too late as he was trying to take a chance and drive over quickly. Auto and General sent me a mail stating that i could have avoided the accident, therefore they will only pay 60% of (Market value - 40 % Salvage value). When you take up insurance with them for the first time they promise to pay 100% Market-Value of the third party damages, but when reality strikes they make up excuses for them not to pay up what they are liable to pay. As an innocent driver on a public road, i did not anticipate such to happen nor was i even in the wrong, but i am made to suffer all in the name of insurance trying to ******* people and promise **** products to clients. If you are with Auto and General, do make sure you have evaluated them thoroughly.

Wow i have never been so insulted in my life, your representative called me to tell me that even if i go to court they will still win because the court favors the insurance company. It is with great regret that we have to go this route. You can keep your 60%, i am going to name and shame you.

It is really unfair of you to state that based on the merits of the matter i am also part responsible when i did everything a normal reasonable person would do to avoid danger. No one would jump into fire purposely, what saddens me is your failure to also prove that i am also responsible for the accident, all you are saying is that you are applying the law but in this case the very same law favors the actions i have taken. Please respond back with a statement that clearly defines how i am also part responsible and what is it that i failed to do on my part.
