Third party claim

A few weeks ago my bakkie was rear ended by a vehicle insured with Auto and General. I stopped behind another vehicle turning to the right on a straight road and the insured's vehicle stopped closely behind me. Another vehicle failed to timeously stop and rammed into the insured vehicle, which was standing still behind my vehicle. The impact of the accident forced the insured into the rear end of my bakkie. The vehicle in between, referred to as the insured's vehicle, was extensively damaged, whilst my vehicle's bumper and bodywork was slightly buckled. The insured provided me with the details for a third party claim with Auto and General, who subsequently refuted my claim because they claim the person that caused the accident is totally liable for all the damages, including my bakkie. Their motivation for rejecting my claim is unacceptable as the insured stopped closely behind my bakkie and it's the insured vehicle that bumped into mine. NB: If the stopping distance was greater, as required by law, then this mishap could have been avoided ! Such sad excuses when it comes to payout of normal and third party claims !!! I don't understand why the insurer doesn't handle the recovery of the total damages from the person who they claim is responsible for the accident and not just ignore my third party claim, when it is the insurer's vehicle which damaged my bakkie. Besides, one obtains a comprehensive motor vehicle insurance for the unexpected mishaps, so insured is not burdened with unnecessary liabilities. Based on this experience, I will never use nor recommend Auto and General to anyone !!!

We regret to advise that we are unable to entertain your claim. According to the information at our
disposal, our client was not the cause of the accident.
▪ The first car in the collision is the liable party.
▪ The second car cannot be held liable as had the first car not bumped into him he would not
have bumped into the third car (front car).
In view of the above we refute liability and our file is now closed.
Kindly note, we will defend our policy holder on all legal proceeding related to this incident.

Auto and General tried to pacify the situation by reviewing the rejection of my claim when the outcome remains exactly the same. So I'm not sure why they even bothered to contact me about this matter when the points are clearly highlighted above. My feeling about them is still the same. I'm not interested in the technicalities about who caused the accident but rather in who is going to repair my vehicle when it was bumped by their client. Still unhappy and disappointed as my claim was poorly managed !!
