Beyond Economical Repairs Payment

On the 19th of March 2017 at around 22h45, I was involved in an accident with someone who is insured with Auto & General. I was travelling from Polokwane to Midrand via R101 road. The accident happened at Mokopane on R101 as a result of (The Insurer) Failing to stop on a stop sign. After all logistics were done with Police Officers and his insurance (Auto & General), the agreement was that as my vehicle was not insured and couldn’t be drivable let it be towed together with his vehicle for storage. Both cars were stored at KK Towing & Mechanical Repairs in Mahwelereng and it was agreed that the claims will be done simultaneously for repairs. I’ve been communicating with the policy owner via cell phone as I couldn’t be able to go to Mokopane as that was my only car, on the 28th of April 2017 Policy Owner informed me that my car was still at KK Towing & Mechanical Repairs and not yet towed to assessment Centre, because I had to log the claim separately as a 3rd Party. I started with the process of logging the claim on the 2nd of May 2017, sending all the required documents to the Insurance as requested.

Auto & General informed me that for the car to be released to be assessed I must firstly pay (KK Towing & Mechanical Repairs) for storage and towing fee which amount to R8 650.00. I didn’t have the money by then, I had to make loans from different institutions to at least try my level best in order to fast track the whole process of fixing my car as I didn’t have one. I also informed the policy owner about my financial status but he couldn’t assist by then. I made all the payments and the car was released for an assessment and after assessment was done the results were saying the car was “Beyond Economical Repairs”. After that I had to do follow ups now and then to find out what was going to happen, I was informed the investigator was still busy with the investigations. I had to wait up until I received an email on the 26th of June 2017 with the attachments showing the payment that is going to be released and the forms that I should complete. I did complete their forms and payment was done on the 4th July 2017, but even though the payment has been done, what am I going to do with R16 572.00 to fix the write off vehicle.

By looking at the amount to paid out I’m seriously worried that it seem to be like I’m being paid only R16 572.00 for settlement or repairs while the car is “Beyond Economical Repairs”, I’m saying this because of the following:

They've paid out R23 222.00

I’ve paid R8 650.00 (for storage and towing) excluding towing from the assessment Yard in Mokopane to my Place in Midrand on the 31st May 2017.

They reimburse R2 000.00 for towing as per attached docs, which means they have paid R14 572.00 + R2 000.00 = R16 572.00

The question is if it’s true that my car is worth R58 950.00 as per their criteria of valuing the property, and they are paying this amount for me to fix the car with R16 572.00, is this truly fair. Rather let it be them fixing the car and incur all the costs rather than me doing the run-arounds and getting frustrated. I bought this vehicle in August 2012 and the last instalment payment was February 2018 but I took all my savings last year December 2016 and paid up the vehicle for me at least to save for my kids. I don’t need these guys to replace my car or do settlement as they are doing currently but to fix my car, because at the end of the day I’ll end up paying more than what they are offering.

I’ll really appreciate if you can help me with resolving this matter

Regards
