3rd Party Claim after and accident

On the 27th of June 2015, a learner's driver driving a car insured by Auto and General drove into the right hand side of my car. I have two witnesses that stopped and heard how the driver and copilot apologized and admitted their fault. I did not want to claim from my insurance since my premium will go up and I thought it was not fair for me to pay for a damage that was caused by someone else. Three weeks after I got my car assessed, I received an email saying that I will receive R4,840,04. They did not explain how they came up with that amount of money. After calling Auto and General to get an explanation, I received an intimidating email saying that I was equally negligent because I did not avoid the car coming towards me, and that they will only pay 80% of the quote (which I did not see until after my query) that their assessors quoted. <br> I was extremely annoyed by the rudeness of the email and their assessment of the accident. <br> <br> How can I be equally negligent and equally at fault when a car crashes into the side of my car without warning? He is the only one at fault, and did not look before turning and he even admitted his fault afterwards.
