To whom it may concern. My name is Lehlohonolo Masinga, last year IN mid November I app**** for vehicle finance at Audi Pre-Owned Wonderboom Dealership and MFC approved my application. I then signed the contract and on the 29 November 2018 but took the vehicle home with me on the 1 December 2018 it was a (2014 VW Golf VII 1.4 TSi Comfortline DSG). I then informed the Sales person (Mxolisi Ndlovu) that the sunroof had a problem and he said he would book the vehicle at VW Constantia as it is close to where I work and reside. I realized when I was driving the vehicle a funny noise, only to find out that the sunroof does not close properly. Then the service person at VW Constantia said it needs to be checked thoroughly and they gave me a quote of approximately R40000 excluding labour. Therefore, I told the person that I would come back to her after I have spoken to the sales person at Audi Wonderboom. Therefore, I did inform Mxolisi the sales person at Audi, and he said he would get second opinion on the matter. I drove the car for a week or two. Then on 26 December 2018, the car decided to give me troubles as the engine light came on. In addition, I took pictures and send them to Mxolisi and he said he’d loan me a car the following day. The following day on 27 December 2018 in the morning, I called my insurance and requested towing truck so that the car can be taken in for repairs as per our conversation with Mxolisi. Ever since the car went in for repairs til date 7 May 2019. I made a couple of calls to find out as to how far with the car, the car was only attended in January 2019 not sure of the exact date. Then it was found that the Megatronics is faulty and i was informed that I installed software in the vehicle of which that was Not True, because I never installed any software on the vehicle and Mxolisi also knew that, and told them as well that the vehicle has not been upgraded to boost its performance of any kind. Therefore, the Technicians and or Mechanicians at VW assessed the vehicle and I got a feedback that the gearbox needs to be changed. Fine, the vehicle was taken to Gearbox Specialists, somewhere in Wynberg Sandton. Then it was taken to Menlyn VW as Mxolisi the sales person at Audi Wonderboom told me. Then a month or so ago, I made a follow up as to how far is the vehicle, and I was told that the vehicle will be ready in a day or two. I then waited for a day or two, but the vehicle was not ready. Because apparently they installed wrong parts in the gearbox. Kindly note that I have been paying for a vehicle that I only drove for three weeks, and I am currently driving loaned cars from Audi Wonderboom Dealership ever since the vehicle broke down. Pity I cannot attach any documentation as proof that I have been loaned vehicle(s), because all the paper work is at the dealership. So now its 4months down the line still the vehicle is giving them a problem and I am not getting specifics as to when will it be done and so forth. Last week Thursday 2nd May 2019, I went to the Dealership because now I'm getting all frustrated by all this and loosing valuable time at work by going up and down to the dealership to sort this out. I even took leave thinking maybe this matter can be resolved quickly. I was promised that I will get feedback of the progress on the vehicle and on the 6th of May 2019 only when I called the dealership, I was told that the car is now somewhere in Sandton for the Settings on the Megatronics. This issue of the vehicle is taking its toll on me and my family to a point that I want to cancel the whole deal. Please find this letter as a notice of agreement to terminate. I even suggested to the Dealership that they either Trade the vehicle IN on conditions that they cover the Shortfall. However, I do not think they will want to do that. I also suggested a Replacement Deal, and I was told that someone would check for me on his or her stock if there were a vehicle similar to mine so that a replacement deal can happen. I do not know what is the way forward, be it the Replacement deal will happen or not because I need to get this done and move forward on from all this. I have spoken to my legal team about the matter, so before I take any drastical steps, can MIOSA intervene in the matter. However, when I took the vehicle for 90000km service at VW Constantia on the 28 August 2019 I informed the service person (Priya Pillay) that could they evaluate the vehicle for me because there was a funny knock on the suspension. Then, Priya told me that it was the steering wreck that was faulty because the vehicle was involved in motor vehicle accident apparently, which I was not informed by the dealership and I have always suspected. However, when I raised the issue of MVA with the Dealership they always seemed surprised with the info I was raising to them. Then the Dealership took the vehicle again on the 25 September 2019 because of the steering wreck, and they loaned me a vehicle on the 2 October 2019. Then they brought back my vehicle on 8 October 2019 after they took it for “repairs”. I recently found out that I don’t even have Motor Warranty as the funds were all used up, but my contract states differently from what the dealership is saying. Nevertheless, I was sold a Bidvest Warranty that I am still paying on a monthly basis but I cannot claim from it due to all these reasons. And when they repaired the vehicles Megatronics three weeks after purchasing the vehicle, they used my Warranty to repair the vehicle, hence now I am told my Warranty funds has depleted. Of which, I believe that the vehicle was not supposed to be repaired with my warranty and I did inform them but they (Mxolisi) said I shouldn’t worry because I will still have enough funds to last me. Hardlky six months down the line, the steering wreck started giving problems, and the manager Dorietha refused to fix my car. After constant fighting with the dealer to repair my vehicle or fix my Warranty I am still NOT winning. Basically, the vehicle will give me problems always hence I want to cancel the deal all together and start a new deal for another vehicle that was not involved in a MVA. What Audi Wonderboom Pre- Owned dealership is doing to its customers is not on at all. So I need this car off my name completely so that I can move on from this nightmare of a car.
