<p>Hi</p> <p>I own three units in the same complex in Johannesburg. I made my levy payment timeously for all the units in the correct bank account. However, on one of the units (unit 41) I mistakely put in the reference number as unit 4. The agents i.e Astrodon have charged me a penalty for this mistake even though they have received the payment timeously in the right bank account. They now refuse to reverse the penalty which I find grossly unfair. </p>

Dear Naz,

We refer to your complaint herein of which we hereby confirm the following:

  1. In terms of a section 32 EAAB trust account held with any banking institution, we require positive proof and cer*****y in order to allocate any funds to any account, as such our statements clearly request the REF to be used per payment in order to efficiently and correctly allocate any/all deposits to the correct clients account concerned.
  2. We confirm that in terms of the Act, levies are due on the 1st day of the month in advance of which we allow up to and including the 7th of the month for any payments to reflect. No payment were allocated to unit 41, due to you not using the correct REF as required by the statement, hence the payment could not be allocated accordingly.
  3. On the 8th a reminder letter were sent to you informing you that no payment were recorded, including an SMS sent to your mobile number registered at our offices, in an effort to resolve the outstanding amount reflecting on your statement. Such letters and charges are in respect of the act and council of debt collectors.

We confirm that the payment has been re-allocated, and the reminder letter and SMS charges has been reversed in good faith, taking into account the error made by you whilst effecting the payment.

We trust that you will ensure that you use the correct REF as and when effecting payments in the future to ensure prompt allocation of the funds in terms of the trust act.
