Nuutgevonden house, Stellenbosch with major defects due to Asrin Property Developers

I bought a house in NUUTGEVONDEN, STELLENBOSCH, built by Asrin Property Developers. They are registered with the Ombud for the building industry, the NHBRC.

NUUTGEVONDEN is in a marsh area, though Asrin did not built any drainage system for surface water at the 52 houses or 4 blocks of flats. The water table gets high in winter, and Asrin's lack of compliant waterproofing in the foundations and walls causes endless problems on exterior and interior walls. In my house THE WATER UNDER THE FOUNDATION PUSHED UP INTO THE BEDROOM CARPETS. We live on the concrete now without any floor covering. The strength of the slab is compromised due the water pushing into it on a 9 meter length, and an inner wall on that weak area is sagging.

In my garage, the rain water from the stoep runs through the wall onto the garage floor. A section of the floor then have WATER PUDDLES FOR DAYS AFTERWARDS.

The foundations were built the cheap slab-to-soil way and not a floating foundation as was recommended by the first geotech study, considering the clay soil (independent from Asrin's own geotech report).

To top it all, my house was signed off on the SANS Certificate of Completion with the NAME OF A DIFFERENT DEVELOPER and different registration number. As if Asrin did not build it (?) (Contact me for the pdf copy).

To top it even further, Asrin decides themself how long their WARRANTIES will be, even though the LAW PRESCRIBES exactly what WARRANTIES are valid for how long: Housing Consumers Protection Measures ACT of 1998. As an example, they reduced the 5-year structural warranty to 1 year. (Contact me for the pdf copy).

Another example, the houses they built in Strandfontein near the mosque, had no written warranties and a VOETSTOOTS CLAUSE was written into the offer-to-purchase contract. (Contact me for the pdf copy). The distorted warranties are even further bizarre as they offer a 1 year warranty on REPAIRS in some contracts. But as they sell or try to sell newly constructed houses as voetstoots, they are not willing to do any repairs. I made numerous calls to them and emailed photo's, but they deny liability within the timeframe that the law prescribes. They also misguide themselves that a subsequent owner have no claim on the prescribed warranties, even though the law is very clear on the rights of subsequent/second owners.

Asrin is a NHBRC registered building company of which their nearest office is in Durbanville.

I totally agree with the review of Asrin's Azure complex in Bigbay, Cape Town, that Asrin do not have the competency, the pride or the integrity to build quality homes or flats. Though they claim to be all that on their website.
