Bought a lemon, refund denied

<p>Towards the end of February I went to Arnold motors and we concluded the sale of the vehicle , A 2008 Mini Cooper S Clubman, for R125000,<br />The salesman was Johan ( ********** 513)<br />The day after the sale I started experiencing problems with the sunroof, it didnt want to open at times. So i took the car back to Arnold Motors the same day, I spoke to Johan who told me to take the car to their workshop, which I did. the mechanic checked the sunroof and asked that I bring it the following wednesday. As i was driving home, I started hearing a noise at the back by the wheel, I called Johan and he asked that I bring the car in once again. I got to the workshop and was told to bring the car on wednesday and they will check the noise and the sunroof. I decided to go back to Johannesburg. On my way to Johannesburg, the oil light came on and I immediately informed Johan and told him that the sunroof is not urgent but the oil light is, he told me that I must bring it on wednesday and ask them to check that as well. I stopped on the way to top up the oil because the light was worrying me. Every 2 days after that I had to top up the oil. I then went back to Arnold Motors and I left the car there for the day, when I got back they me told that they took the car to check the noise, but the guy who I had left the with was not there, the receptionist Jorinda(very rude) said I can go fetch the car. I went to fetch the car, the noise was still there and as I had to go back to Johannesburg I took the car. On my way back I had to pour oil once again, so when I got back to JHB, I booked the car for a service to check the oil at Tunetech, which is a reputable BMW repairer in Johannesburg. They found other problems with the car, the vanos solenoid needed to be replaced amongst other things. I called Johan and he said I should bring the car in and he will see how they can help me. I asked Tunetech to do the oil change, I paid them almost R3000 for this. I arranged to bring the car back to Klerksdorp the following week. before the end of that week the oil light came on again. I called Tunetech and spoke to Diba, she told me in order to check the problem they would have to strip the car and this is a big job and it is going to be very expensive. They advised me to take the car and ask for my money. The following week I took the car back and asked for my money, I spoke with Johans manager and they told they cant refund me. We had a big argument and I left. As I was leaving Arnold the owner of the dealership called me and said I should bring the car to their workshop. When I got there Jorinda accused me of using the wrong oil in the car based on the invoice I received from Tunetech, I told her thats not true but we left it there as they took the car in. So I left the car with them, this was around the beginning of March, it is now July and the car is still with them, they changed the engine and did a few things to the car. I'm scared if I get the car back from them its going to give me continuous problems</p>
