In Feb 2015 I signed a 5 year lease agreement with Ariva, was assisted by Matilda Mlambo. At that time was not qualifying for vehicle finance, Ariva came to my rescue, thank you. I declared upfront to Matilda that I would like to take ownership of the car when the lease expires. So she made arrangements and spoke to her manager at that time, forgot his name but a male if I remember properly.
Matilda then accompanied me to collect the car at Kia Rooderpoort on the 11th of Feb 2015. She then gave me a letter signed by by her manager stating how much I will pay for the car after 5 years. The letter was signed with a red pen, it stated that I will pay R40 000 to take ownership of the car.
Unfortunately I have looked everywhere, can't seem to find that letter, I have sent numerous emails to a lady called Lesego and she said to me that letter is not with my signed contract. I asked her to ask Matilda and her manager at that time, she said to me the people I am referring to are no longer with Ariva.
My lease will expire in three months time, I asked for a copy of this letter, was told it not in my file. Yes I lost the letter but why is it a coincidence that Ariva also does not have this letter. Why was this letter not filled like my lease agreement. So now it's my problem that Matilda and her manager do not work for Ariva and I can't be assisted.
Another complain in May 2019 I received a call from Meagan from Ariva, he said in 2016 I have exceeded my mileage, he was very rude. How on Earth a mileage for 2016 was only identified in 2019.
I am really so frustrated by this company, I will not recommend it to anyone. I have been very loyal never missed a payment now they want to rip me off just because I lost the letter.

We have investigated your complaint fully and would advise as follows:
We unfortunately have no document on file which relates to an agreed payment of R40000 to take ownership of the vehicle at the end of the term. The only working document we have attached to your agreement relates to an assumed purchase price which is considerably higher than this
We do note that during 2016 a request was made by you to early terminate your agreement and, at this time the penalties due, should you surrender your vehicle, was in the order of R40155. It is possible that this is what you are referring to.
Should you be keen to take ownership of your vehicle at the end of your current term we would need to, at that time, provide you with a revised purchase offer based on current market trends
As regards the excess usage charge it is noted that your term to date usage has fallen back within contracted parameters and we have accordingly reversed out the charge of R1305 raised in January 2018
We regret that we cannot assist further at this time but, should further documentation come to the fore which confirms an alternative commitment made to you, we will gladly review the matter again

I will however look for this letter again, i pray that I find it. It is so pathetic that your previous managers make signed agreements and dont file now it is my problem. I really pray that I find this letter.

What you are saying now is very confusing, when I asked Lesego for the letter she said it's not in my file, I asked if someone can write a new letter for me then, this was her response below:

The welcome pack I received on 11.02.2015 clearly states the ownership options:
Option 1 I qoute: There will be a small residual value at the end of the contract""- it does not say the offer of purchase will be based on current market trends.
Please tell me what is the meaning of a small residual value at the end of the contract as stated on your welcome pack.
I swear to God I was given a signed letter by one of the managers stating I will pay R40000- it's a pity I misplaced it????

Whilst being sensitive to your obvious frustration, please note that we do consider certain of your comments as defamatory and would ask that you please refrain from the use of such as there is nothing at this juncture to substantiate your claims. There has been no wilful intent on our part to mislead you and, at this stage the existence of the 'ownership letter' is merely a matter of conjecture.
Having said as much, you have our commitment that should such a signed letter, issued by ourselves, come to the fore, we will very willingly honour that agreement as there is no intention on our side to renege on any previous obligation that we might have made. At this point however we have nothing in writing which supports your contention and whatever documentation we do hold certainly does not in any way approximate the offer to purchase which you have suggested.
Our intention is that should a customer wish to purchase a vehicle at the end of the term that we will consider such an offer and, the purchase price at that time, will be determined largely having considered the prevailing market value of the vehicle at that time and the inherent value of the vehicle in our books (Residual Value) - the latter in this instance being significantly higher than the suggested offer price
As correctly stated by one of our agents such an offer to purchase will be determined conclusively at the time the contract ends but an indicative offer will be made to you 90 days before the end of your current agreement
Please would you direct any further correspondence in regards to this matter to *** where it will be given ongoing attention
