Overcharging

I recently bought a flat in wilgeheuwel and it was registered on the 14th July 2017, end of July i got a statement of R2700 that i needed to pay and when i queried the amount, i was tld about a pro-rata that was not clearly explained to me. Today on the 22nd August my statement R4900 including last month's billing. Does it mean that i will be paying R1900 on a monthly basis for levies and "10 year maintenance plan" as per the statement and there hasn't been any maintenance work done in years which makes me wonder where the money is going to??? The complex needs painting and the electric fence isn't working yet we charged a maintenance plan that isn't there?? This is ******* especially when you only getting R5400 when one rents outs his/her property p/month and we still have to pay for rates and taxes.

The charges on your levy statement are in accordance with requirements of the Sectional Titles Schemes Management (STSM) Act and the Community Scheme Ombud Service (CSOS) Act.

The STSM Act requires that the Body Corporate, represented by the elected Trustees, determine the estimated annual operating costs. This budget is presented at the Annual General Meeting (AGM) for consideration and approval. The Body Corporate ***ners) approved the budget at the AGM and the levy contributions payable by each owner.

The STSM Acts also requires that a scheme (complex) establish and maintain a reserve fund to cover the cost of future maintenance and repairs. There is also a minimum prescribed amount that must be contributed to the reserve fund. The Trustees presented the required amount at the AGM and the maintenance reserve levy was approved by the Body Corporate.

The CSOS Act requires that all members of the Body Corporate ***ners) pay a CSOS levy.

The above 3 levy contributions (Standard, Maintenance Plan and CSOS) appear on your levy statement along with Water which is billed according to monthly usage and Domestic Effluent which is billed monthly as per the municipality.

On owner is liable for the pro-rata levy contribution from the date the unit is registered in the owner’s name. The unit registered on 12 July, which means you are liable for the contribution from 12 July – 31 July. The previous owner was liable for the amount from 1 July – 11 July. Levies are billed monthly in advance, which is why your first statement contained both the pro-rata July amounts and the August amounts.

The Trustees elected at the AGM are in the process of attending to urgent maintenance. The electric fence and general security have been identified as priority projects. The Trustees meet regularly and you are entitled to attend a meeting with prior notice to discuss your concerns with the Trustees.
