Ignoring ongoing problems
We have been complaining , since April 2017, to our complex Trustees (Stellenberg Estate in Magaliessig) & Angor - Herman Frederick over the disgusting/rule breaking behavior of a tenant. Even the landlord, Phyllip Jarvis, is ignoring these actions. I'm appalled at how Angor, when asked for help from an owner myself, pushes the responsibility down to the Trustees (never knowing what to do as Angor puts up so many road blocks) & never actually stepping up. WHAT ARE WE PAYING YOU FOR????? This tenant has broken countless rules & NOTHING has been done by either the landlord or our managing agents. Other tenants have been threatened with violence at their doorstep, through the night partying, Police has been called to help out (this woman pushes them out shouting "I will do what I want, I pay to live here"). It's been very clear that Angor will only act when its something they can make money from, the trustees only act when it gets personal & the landlord.... well, his reputation proceeds him here on HelloPeter itself. For 7 months, all we got was "we are looking at taking legal action", "the landlord says her contract ends in Jan 2018", and Angor.... this is my favorite "call security". Our security doesn't want to deal with this woman because of her attitude!!! Mr Frederick, How would you feel if you know your daughter was living in a complex this chaotic? And Mr Jarvis, how can you stand by and ignore the fact that she is a nuisance to this complex PLUS other peoples' live are at threat here? I am disgusted at how you all handle this situation. Absolutely disgusted!!!
The Sectional Titles Schemes Management Act does not allow a Managing Agent to act on behalf of the Trustees of a Scheme. We can assist the Trustees in fulfilling their duties, advise on community living matters, and can act as instructed by the Trustees, as long as the instruction is within the law.
With regards to the tenant in the neighbouring unit, it has been noted that the tenant has contravened the Conduct Rules with regards to noise levels, littering, hanging washing in inappropriate places and indecent exposure. The issues have been raised with the owner of the unit, who is responsible for the behaviour of his tenant. The Trustees and the security team have proceeded within the law: police have been called to intervene, security has intervened and continue to monitor the unit and penalties have been levied in accordance with the Conduct Rules. A peace order has been requested. The owner of the unit has confirmed that the tenant will vacate the unit at the end of January. The next step is for the Trustees and yourself to make an application to the Community Schemes Ombud Service (CSOS). CSOS’ role is to assist where internal resolution processes have failed.
While we fully understand your frustration with the situation, ANGOR may not remove a tenant. ANGOR has notified the owner of the unit in writing that he must attend to his tenant. If you feel threatened, the correct course of action is to contact the Police or security for the Estate. ANGOR can supply you with the paperwork in order to make an application to CSOS, but we unfortunately cannot apply on your behalf.
