Money taken - service not rendered

<p>I employed the services of Andre Putter Private Investigator in December 2015 for a private case. Our first communication was telephonic when he gave me his rates R5800 to carry out the requested job. He confirmed that until he was satisfied with the information & proof he got with regard to the brief, that this money would suffice even if it took months. He spoke about furnishing me with a Report, Log Books of "stake outs" & Photos as proof of what I needed to know to conclude my case. I transferred the monies immediately & without hesitation. I sent him photos of the subjects. I kept him posted of my subject's movements & gave him some leads & info. In January 2016 I requested a feedback meeting. He arrived with his assistant empty handed saying they have been following the subjects, gave me information on their body language, that they had been seen at a Pub but showed me no photos or anything. He went on to say that from the body language alone it cannot be proven that the two subjects are anything other than friends as they seem very comfortable with one another. He suggested downloading an App which he could only get from a company in Cape Town he said at a cost of R2800. The company would send an SMS to my subject & as soon as he opened it, it would download the App so that msgs could be seen & conversations heard. I agreed & transferred the monies the next day. Back & forth I asked him about their whereabouts, any photos & the SMS which my subject never received. So I asked Andre to change cell number in case my subject was using the other phone more. He became impatient with me saying I keep moving the goal posts. I even went to the trouble of sending a Valentines photo of my son from Aftercare to see if my subject would open it. He never received it. Eventually Andre read my Whatsapp msgs but didn't reply. He would not answer my calls. I asked my Brother in law to communicate with him. Andre then came to visit me in May 2016, still empty handed & said he had met with someone who knows the other subject & that he would do a last stake out on 21 May 2106 & thereafter he would send my brother in law the full & final Report, Log Books as proof of stake outs & photos etc. My brother in law spoke to him the week after the supposed stake out & this is where Andre said that not only would he send him everything via email but when my brother in law asked him what he found on that weekend, he answered that the other subject was at her place of residence. I know for a fact that the two of them were at my subject's place of work for the weekend as I have proof thereof !!! Todate we have received NOTHING, no log books as proof of stake outs or following the subjects, no photos (except for one which I received via Whatsapp of the back of my subject's car, which I gave him the whereabouts of), & definitely no Report. Andre reads but does not reply to my messages & has completely ignored my Attorney's written request/demand for the abovementioned documents to help my case. Andre claims he rendered the service for which he was paid but where is the proof that he said would be given to me once the case was completed?? He took our money but has given us nothing so how are we to know if he carried out the job or not? This was not what he offered & does it not make sense that a Private Investigator HAS to give the client some kind of proof of the investigation by way of photos, reports or anything else. His business dealings are completely ********* & I want to be refunded the full R5800 & R2800.</p>
