Bad Insurance Practise

On 29 December 2016 the vehicle is parked in the parking lot of Somerset Mall where someone knock the vehicle while we were in the mall. Pushed the bumper badly and there may or may have not been a flaw such as a chip in the windscreen, which in my opinion with the knock on the bumper the windscreen crack from the right side across the entire screen. The vehicle belongs to my mother in-law which the vehicle insurance is in her name. I took it upon myself to go out to the police station to report the incident due to her not knowing the area. I too am listed as an additional driver for this vehicle. Few days later on her request I made contact with her insurance to initiate a claim for the bumper damage as well as the windscreen which everything went off fine. The insurance company never made contact to say that the claim has been approved, which the panel shop did, in having to let me know that we can drop the vehicle by the repair shop.

A couple of days later I get a call to let me know that we can collect the vehicle which only the bumper was repaired and on collection I get told that there is an excess of R3000.00 for repairs done on the vehicle worth R4431.98. Now according to my mother in-law there is an excess waiver on the vehicle and yet they want to charge an excess of R3000.00. I checked with the broker which is Unison Risk Management Alliance (Pty)Ltd and they start telling first about the windscreen is not cover due to the crack in the windscreen could not have been created by the bump on the bumper. Then I had to hear because the vehicle was in my possession that is why there is an excess. The more I'm trying to tell them but I never drove the vehicle and that the car was stationary the more I seem like the impossible one.

I went to the police station in a different car to the one that was in the accident to report the incident and this is known as well but still they are insisting that the vehicle was in my possession. How the assessor can up with this conclusion is beyond me.

I am still waiting on the insurance company or broker to get back to us about the windscreen and what the true reason is for them not wanting to pay for the claim. In the meantime we have the repair shop demanding the excess be paid from either us or the insurance company.
