**urgent *** Compensation to Damaged property***

On the 28th of September 2017 a delivery truck with the below details entered the driveway of my parents’ residence: 157 Morewood road Clare Estate, Mr and Mrs Dayanarain which had caused major damage to the surrounding areas. Note: As per the delivery invoice it does state: Safety: the driver is not authorized to enter anywhere where his safety or that of the vehicle is at risk. Delivery invoice number: ********** Customer order number:302151 Vehicle registration number:HWN72MP Truck number:CQ12 Time out: 11:40:30 Driver name:Cassim

Issue one: My mother and were not at the mentioned address at the time when the truck had arrived hence, no one was available to accept or sign for the delivery when it had arrived, (kindly take into account that we have received numerous deliveries previously by your company, so we are well aware that the driver is required to either confirm details of the owner of the residence or to have the document signed before dropping the load). My father who was at the address,is unable to move around due to him being a stroke patient, suffering from right sided paralysis, confined to a wheelchair,heard the commotion outside and tried to see what was happening, had fallen down in the room. To date I am unsure as to how long he was on the floor as he is unable to speak. Issue two: upon arriving home to our surprise were we advised by the neighbours to park the car elsewhere as a truck was stuck and skidding/sliding in the mud of the driveway and was unable to move forward. Due to the previous day’s heavy rain the soil became extremely soft and DANGEROUS for any heavy vehicle entering the driveway, especially if that truck weighed 15 tons which was carrying another 15 tons! This mess could have easily been avoided if the dispatcher had noted the rain and held back the delivery for another day as we were in no rush to receive the crusher as the building contractor did not work that day due to the rain, we never received a call from AfriSam, the trucking company or the dispatcher confirming a delivery address, advised of an estimated time of delivery or when the driver was nearby… had we known we would have requested delivery for another day which would have been convenient for my parents hence no one was available at the residence, and if the truck driver had noticed the wet soil and the rain….. Issue three: we were advised by the neighbours that the truck had been on our premises for a long period of time with a portion of the crusher offloaded in front of the main entrance to the property and gate. Which blocked the drive way and was unable to drive any vehicles into the premises or remove any vehicles that was in the yard Issue four: Several attempts were made by the drivers to move the truck only for it to slide closer and closer to the boundarywall and telephone pole. Furthermore the workersaccompanying the drivers and including the drivers took it upon themselves without seeking permission to utilise the crusher under the wheels to try to remove the truck. (Refer to image 6, 7, 8, and 9) Issue five: Our neighbour had also advised us that upon the vehicle entering the driveway, the driver had driven the truck over their manhole and he was promised compensation by the driver for the damage. The neighbour is now requesting compensation from my parents to cover the cost of fixing the manhole that was on his property. Issue six: due to the truck skidding and sliding along the driveway, it removed a large amount of soil which caused the water pipe to be exposed and separate in two, the driver did advise that he managed to stop the outflow of water, however I later noticed that all the driver did was bury the water pipe into the ground without shutting off the water, thus causing a large amount of water loss over the hours that he was stuck on the driveway and a looming high water bill. Issue seven: after some time and crusher had been wasted, the truck was eventually pulled out however grazed and broke parts of boundary wall, pulled the telephone pole, and the line which is attached to the house, had pulled off a part of the fascia board attached to the roof of the house. When I had questioned the drivers about the crusher and damage, I was reassured numerous times by Cassim and driver of vehicle registration HTX633MP that AfriSam will compensate my parents for the damages and the crusher that was unnecessarily used and that AfriSam will bill the trucking company for any expenses as the company was insured and will be liable for settling any costs that will arise. This was confirmed by both the truck drivers present here on that day. One of the drivers advised that should the truck not be able to be towed out, it will be left overnight which we did not have a problem with, and that he will need to confirm with his manager who is the owner of the trucking company. The manager was contacted who after some time had arrived, however when he eventually, did the truck was already removed and was at the beginning of the driveway. He never approached my parents to apologize for the inconvenience and stress that my parents were both put through and for a conclusion of this claim, hence I am raising my concerns to Afrisam as the trucking company is contracted to you. The driver further advised that he is willing to fit the bill for the broken water pipe as it was his fault that the pipe cracked and separated into two and was willing to purchase a ton of crusher as compensation for the wasted crusher that ended up in the ditch or that was used. After the trucks had left we were forced to undertake to cost of having the water pipe fixed on our own. (Receipt attached) The driver contacted my mother the very next day and I had spoken to him as he advised that he is willing to pay ZAR100 for the next 6 months to cover the bill of fixing the water pipe, unfortunately that will not suffice as when building contractor purchased the crusher, we did not request him to enquire if we could pay over a period of time, the amount was paid in full. I did liaise with our building contractor who advised that he was expecting the delivery early that morning as he requested, however the vehicle was dispatched at 11:40, which could have arrived much later. In view of the above, since the driver Cassim can afford to pay to pay ZAR100, I would suggest that he take a loan from his company/employer to settle the claim for the manhole, fascia board, and bust water pipe.

In view of the above, should we not receive positive feedback with this matter, we will have no option than to take this matter further LEGALLY.
