4 months without solving 3rd party claim

On 29 December, someone drove into my car in Cape Town and caused quite some damage to my car.

The guy had a rental car from Bidvest.

We exchanged details, took pictures, went to the police and got the report. I called my insurance to get the no claims letter as I would obviously want to claim from the party who caused the damage to not pay access myself. I submitted all documents needed (including 3 assessed quotes) 3 times to 2 different people after they always claimed not to have received my emails.

Today is the 16th of April and my car is still not fixed.

I got the contact of at least 5 different people who are in charge for my claim in the past 4 months. I'm going from Bidvest Car Rental, IUA Business Solutions to African Recovery Solutions and back.

For over a month now, I can't get through via the phone numbers provided in the email footers. After every 3rd email I send I get the standard reply: "The settlement file has been prepared and we await management approval." I don't get any response when I ask for the details of management and the person in charge.

I'm sitting with a rental car, that Bidvest is not going to cover and don't even get information on how long I can expect to be without my own car.

I have never in my life experienced such unqualified, impudent and insolent "customer service". which is clearly aiming to sit my claim out.

So a few hours after my review here, I got this response: "When looking at the circumstances surrounding an accident it is often the case that both parties are in some degree negligent or to blame for the accident. The degree of negligence will differ from case to case and will determine the portion each party needs to contribute towards the other party’s damages in accordance with The Apportionment of Damages Act 34 of 1956. (Act of which is attached hereto for your ease of reference) Previous court decisions and the actions of a reasonable person under similar circumstances are used as a guideline when determining the degree of negligence. A reasonable person traveling on the road, being in control of a vehicle, is expected to adhere to specific duties and responsibilities. The two important duties of any driver is: 1. To keep a proper look-out, this includes awareness of what is happening in his/her immediate vicinity. This will include nearing or entering an intersection such as cross roads and off-ramps; and 2. To drive at a reasonable speed, irrespective of the speed limitation placed on the road. Whether a person was travelling at a reasonable speed will depend on the specific circumstances present at the prevailing moment. Kindly find attached our settlement offer. We confirm merits (how the accident happened) warrant an apportionment of 60/40%, however we have provided you with a 70% straight offer." The 70% were not even calculated from the lowest quote that I got, it's a random number that I can't even retrace. I took the matter to an attorney now.
