Hi there, I would like to formally lay a complaint against your African Bank employee ( Grey or Graig)…Something unsettling happens to me today, when I was followed at my work place harassed me and in front of my Area Manager and team member. From what I know Dept collectors Act and the code of conduct for dept collectors specifically prohibit such actions. I’ve never felt so humiliated in my whole life. He asked me if we can have a chat in front of my colleagues I answered “ you followed me in my place of work” then I stepped outside, while we talked outside he insisted we went back inside. Worst of all I work in a service business my client walked while he was busy wanting me to agree to his terms and conditions, he didn’t even want to read what I was signing. My client had to wait 10min while I had said to him I’m at work. This is unacceptable, I understand people have deadlines in collecting debts but not making the consumer feeling uncomfortable and embarrassed. I’m so disappointed and disgusted!
I am writing to formally lodge a complaint regarding the conduct of one of your appointed debt collectors, Graham Viviers, who did not claim to be representing Sky Trace pretending to be working for African Bank. I only found out just now that he **** because I couldn’t sleep but do my own research.
Mr. Viviers approached me at my place of work, which is a highly inappropriate and unprofessional setting for debt collection activity. Not only did this violate my privacy and dignity, but it also placed me under extreme pressure in front of my colleagues, leading to ************ and embarrassment. I was coerced into signing an agreement without being given the time, space, or information to properly consider my options.
Additionally, during our interaction, I informed him that I had previously spoken with an African Bank representative over the phone and expressed my intention to settle the outstanding amount via a lump sum payment. Mr. Viviers dismissed this by falsely stating that the person I spoke to was likely from a branch, whereas he represented the "head office." I have since confirmed that this was untrue.
To further add to my concerns, he failed to present any formal letter of collection, did not identify himself as being from Sky Trace, and misrepresented his authority. This kind of conduct is both ********* and misleading, and it reflects very poorly on African Bank and its affiliates.
I hereby demand the following:
That I no longer be contacted at my workplace under any circumstances.
That all future communication from African Bank or any third-party agents (including Sky Trace) be made in writing only, via email or post.
That African Bank formally investigate this matter and provide me with feedback regarding the conduct of Mr. Viviers and Sky Trace.
That my right to privacy and dignity be respected in line with the National Credit Act and POPIA.
If this matter is not adequately resolved, I will not hesitate to escalate this to the National Credit Regulator (NCR), Law Society and other relevant bodies.
I trust you will treat this matter with the seriousness it deserves.
