I have been on administration order with Adcol Debt Administrators since January 2016. A monthly deduction of R900.00 was made from my salary, and a total of R92,400.00 has been paid towards the debt. I believes that the debt was fully settled in January 2025.
Upon contacting the administrator, I was initially informed that an outstanding balance of R16,000.00 remained. Subsequent inquiries revealed that the balance had reduced to R14,000.00, and later to R12,000.00, without a clear breakdown of how these amounts were determined.
I seek to have the administration order rescinded and requests a detailed statement of account, reflecting all payments made from the inception of the order to date. ISSUE Whether the member is entitled to have the administration order rescinded and whether the outstanding balance provided by Adcol Debt Administrators is legally justified. RELEVANT LAW Magistrates? Courts Act ? Governs administration orders, including their implementation and rescission. National Credit Act ? Provides consumer protection measures regarding fair debt collection and the obligation of credit providers to give a full and accurate statement of account. Prescription Act ?
I have paid a substantial amount towards the debt, and the fluctuating outstanding balance raises concerns about transparency and proper accounting.
Sad reality is from May this year they added another R30.000 through court order and I was not notified when all that happened , i only discovered that they haven't been paying one account that is now left with R6000.00 and no one answer my emails.
I am stucked can't buy a car, house nor get credit anywhere accept short term loans that keeps on denting my credit score and report.
For anyone able to help me please contact me on this email below.
