I am very irate and disgruntled at the vehicle I bought as well as the UTTERLY DISGUSTING service that I am receiving from the ACS Pre Owned dealership in Benoni Their contact number is *** and their address 52 Ampthill Avenue, Benoni, 1500. I am also very unhappy with BMW financial services, as you are apparently the party which refuses for me to return the vehicle and restructure or cancel the deal.
1. I obtained a 2016 BMW 320D Sport Line (F30) LCI (Manual) from ACS Pre Owned on the 20th July 2019. I was promised by the salesman, Julian, that a spare key for the vehicle, and that it would be given to me when I fetched the registration plates for the car. This was not given to me. I then had to pay R 650.00 to have my vehicle unlocked when I accidentally locked the key in the car, because I did not have the spare that I was promised. The right light cover was to be ordered by the dealership and replaced on my vehicle, as per note made on the attached inspection sheet when I collected the vehicle.
2. I drove the car, and on the 17th August 2019 I noticed that there was an issue with the clutch on the vehicle. I am not happy with the vehicle and notified the dealership on the 18th of August 2019 via WhatsApp and on the 19th August 2019 via email (attached) that I want to return the vehicle and no longer want to keep it. I also advised them that I am willing to take another vehicle from them, being an automatic. The dealership has been giving me the run around and citing system issues and management availability as reasons for them taking so long to get back to me. I had to physically go to the dealership TWICE to try and get it sorted with no fortune. My reason for wanting to return the vehicle is that I’ve had the car for less than a month, and I don’t want to deal with future issues on the vehicle, as the clutch issue presented itself in less than a month. I spoke to Elwin from BMW financial services (cc’d in this email), who advised us that we can only do an asset swap if the specifications of the vehicle are the same, and the price is the same as well. He said that if the vehicle is different in any way, the current deal would need to be settled by the dealership and a new application would need to be done for the new vehicle, which I was still open to doing with BMW financial services. I was then advised that the car would need to go to BMW to have the clutch checked, which I then did and the clutch was then replaced due to wear and tear, as per attached report. The dealership did not disclose to me that the clutch would need to be replaced, otherwise I would not have taken the vehicle.
3. While my car was at BMW Midrand (Waterfall), I was phoned by them and informed that there has been body work done on the car and they threatened to cancel the warranty and motor plan, as the work was not done by BMW. The bonnet was removed from the car and repaired and resprayed, and is out of line. The left fender was removed from the car and is out of line. The right fender was removed from the car and is out of line. The front bumper has been resprayed. This was NOT DISCLOSED to me or my friend who accompanied me to collect the vehicle, and did not see it when I went to collect the vehicle, after I had specially asked the salesman if there any issues on the car, as per attached screenshot of our conversation. I had to beg and plead for BMW not to cancel the motor plan as I would take it up with the dealership (ACS) and advise on feedback I received from them. I phoned the dealership and spoke to Sharon to inform her of the new issue that has come to light in addition to the above issues I already raised. She told me to send the email directly to her, which I did so we could resolve it. After following up twice telephonically and once via email, she sent me feedback saying that BMW have advised that this is not prevalent recourse for me to return the vehicle and sent me the QC report they obtained from BMW East Rand. Please see attached this email. As per the CPA and advice from my attorneys, I am well within my right to return the vehicle and walk away from this entire thing.

How in the world can one BMW dealership pass the car on a QC check and another BMW advise me that the plan would have to be cancelled because the work was not done by BMW???? Nevermind that, how can the dealership sell me the car under false pretenses and not disclose to me that there were issues done on the vehicle just to get me to take the car????????
I would NOT have taken this car had I known the above issues would surface.
I want to return this vehicle and walk away from this deal completely. I also want to be reimbursed for the instalment I paid, as the vehicle is still in my possession, not by my choice but because of the lack of service and delay tactics on the part of the dealer.
All you guys seem to care about is taking my money but providing me with defected good and a PATHETIC excuse of service provided to me as a customer.
And to think I was a VW customer for years. I even traded my VW Polo GTi in at ACS thinking that I would like to move to BMW because I was would receive great service from them as I would now be a BMW client, which is why I chose to go with BMW financial services as the finance house on my vehicle, a move I should never even have considered doing.
I am going public with this and will be making everyone aware of this on all social media platforms. You guys cannot do this to me as a client, or to anyone else who is considering becoming an ACS Pre Owned or BMW client.
