Formal Dispute of Incorrect Credit Reporting by Aquifin

To Whom It May Concern,

I am writing to formally dispute the inaccurate information being reported by Aquifin on my TransUnion credit profile under ID number ***.

The account in question was originally held with Capfin. This debt was subsequently written off and sold to Aquifin. Despite this, Aquifin has reinstated and reported the debt on my credit profile as an active obligation, which I believe is ******** and contrary to the provisions of the National Credit Act (NCA) and the guidelines issued by the National Credit Regulator (NCR) regarding the reporting of written-off and sold debts.

My grounds for dispute are as follows:

1. A debt that has been written off and sold should not be reintroduced as a new active credit obligation under the name of the purchasing entity. Capfin had already concluded its relationship with this account by writing off and selling the debt.

2. Aquifin's reporting misrepresents the status and history of the account, creating the false impression that a new credit obligation exists, when in fact the account had already been concluded and disposed of by the original creditor.

3. The inaccurate reporting is causing significant prejudice to my credit profile, negatively affecting my credit score, financial reputation, and ability to access credit, despite my rights as a consumer being protected under applicable legislation.

I therefore demand that Aquifin:

*Immediately remove the incorrect listing from all credit bureaus, including TransUnion. *Correct any inaccurate information currently being reported. * Provide me with written confirmation that the amendment has been made. * Supply the legal basis upon which Aquifin believes it is entitled to re-list a debt that was previously written off and sold by the original creditor.

Should this matter not be resolved within the prescribed timeframes, I reserve my right to escalate the complaint to the National Credit Regulator, the Credit Ombud, and any other relevant regulatory authority for further investigation and remedial action.
