consumer rights violeted

<p>I bought a new device from Ackermans in Johannesburg Cnr Kerk nd Joubert on the 25 May 2017, I used my phone for 4 days and took it back as it was not working and seemed to have malfunctions, explained that at the shop to the person assisting me her name is Yoliswa, and she said she would fix it instead she did a factory reset and said phone was fixed. </p> <p> </p> <p>I came back four days later with the same issue and was told 7 working days had passsed, I explained to them I was here before with the same issue and asked to speak to the manager , he came out, his name is Maanda looked at the phone and said they must replace it, I could not find my receipt and they said I must come back with the receipt because they cant re-print my receipt, when I came back and told the manager I can't find the receipt , he re-printed it and said he was sending my handset for repairs.</p> <p> </p> <p>I asked him if his sending it for repairs what must I use as I had no phone, maybe they should give me a back up while they fixing this one of which he declined and told me my handset will be back in 20 working days and told the assistant to book my handset and left me there.</p> <p> </p> <p>Came back after that 20 working days, again it being not the only time i came to check on the progress, without a phone. lost all job opportunities and important phone calls i've been waiting for, only to find out that my handset is not back and apperently they can't do anything about it as its booked with MTN, they dont know when it will be back or the progress of the handset.</p> <p> </p> <p>what should I be using while they have possession of my phone of which I paid for cash and have not even used it for a month . i feel that my rights as a consumer have been violeted, my phone was supposed to have been fixed the firtst time around and when i came back again with the same issue they were supposed to deal with it or replace it instead of me doing the run arounds and them not providing my phone.</p>
