VERY BAD SERVICE WITH BRAND NEW BAKKIE

<p>Please may we get assistance in solving the following problem:</p> <p>On March 9, 2016 we ordered from Tata Brakpan a brand new Tata Super Ace.</p> <p>We paid 50 % as a deposit and financed the balance through our bank.</p> <p>It took them +/- 4 weeks to deliver the vehicle to us.</p> <p>On July 8, 2016 the vehicle went in for its 1st 10 000km service at Tata in Boksburg.</p> <p>I got the vehicle back on the same day at 3pm.</p> <p>On July 14, 2016 at 7:45am I got stuck next to the road with the vehicle not wanting to start.</p> <p>I phoned Tata in Boksburg who advised me to phone Tata Assist.</p> <p>After a long struggle a roadside assistance vehicle came to collect the vehicle and took it through to KIA in Nigel who now does the services for Tata.</p> <p>The mechanic informed me that sometimes the diesel pump seals pick up small cracks which causes the diesel system to pick up an airlock, hence the reason why I got stuck on the highway.</p> <p>The bled the diesel system, and told me the vehicle is now ok, and that they will check if they can replace the diesel pump under the warranty.</p> <p>On Saturday morning, 16 July 2016 I got stuck next to the road with exactly the same problem.</p> <p>I once again phoned Tata roadside assist, who collected the vehicle two hours later. They then took it to Tata Boksburg on Monday 18 July 2016, and it arrived there around 11am</p> <p>After struggling with the workshop to get clarity on the problem, they eventually told me that they will attend to the vehicle on Tuesday 19 July 2016, as their day for Monday was already fully booked.</p> <p>According to them they then replaced that diesel pump on Tuesday and fitted a new pump.</p> <p>I was able to collect the vehicle on Wednesday morning 20 July 2016.</p> <p>On Friday morning 23 July 2016 I once again got stuck next to the road, having just left my house on the way to the office.</p> <p>I phoned Tata roadside assist once more, and they arranged for the vehicle to be collected.</p> <p>I phoned Tata Customer care to lodge a complaint regarding this whole issue. Sadly , all Icould hear was regarding the company policy, more than how they can assist us as the Customer.</p> <p>They collected the vehicle and took it once again to KIA Nigel.</p> <p>Since Friday 23 July 2016 this vehicle has been at KIA in Nigel.</p> <p>In speaking to their service manager yesterday I was informed that they were going to replace the diesel pump once again. I asked the reason for the replacement as it was done before.</p> <p>He then said to me that he actually hasn’t drawn the service record of the vehicle from their networking system, but will do so and let me know</p> <p>Two hours later he phoned me to inform me that he noticed the diesel pump was replaced, but he will now try and get hold of the Tata Technicians to find out what the problem is, if they have had this problem before and what he needs to bypass or fix in the diesel system for the vehicle to be in operation again.</p> <p>But my opinion is that this is ridiculous. In the past 20 days , we have had the use of this brand new vehicle for only 8 days, and the issue is still not resolved.</p> <p>As a company we’ve had to rent a vehicle to continue our operation, at our expense, and Tata has no haste to actually keep the customer satisfied.</p> <p>To add to this whole issue, I collected the vehicle from Kia in Nigel on Monday, August 1, 2016.</p> <p>I drove the vehicle for approximately 300km since Monday to this morning.</p> <p>This morning I got stuck next to the road with the same problem. Tata roadside assistance send out CAS Towing. They collected the vehicle and took it back to Tata in Boksburg.</p> <p>So now, for the 4th time in 23 days that this vehicle has gone in for repairs.</p> <p>I now refer to the Consumer Protection Act 68 of 2008:</p> <p>Sec 56 Imp**** warranty of quality</p> <p>This section allows an unspoken condition that every product must carry a warranty of at least six months.</p> <p>The consumer may return goods to the supplier if it does not comply with the requirements of this section.</p> <p>The consumer may return the goods:</p> <p>Within six months<br />Without paying a penalty fee.<br />At the risk of the supplier<br />The consumer can decide if he wants the supplier to repair, replace or refund the product.</p> <p>We can and now exercise our right to claim a full refund of all moneys paid for this vehicle</p> <p>We also Claim all the funds we paid in rental of vehicles while this vehicle was in for repair.</p> <p>The amounts are stated below:</p> <p>1) Purchase price: R166 595.10</p> <p>2) Smash & Grab & Rubberizing: R 5 950.00</p> <p>3) Rental Payments: R 14 906.00</p> <p> Claim Total: R187 451.10</p> <p>Please advise when this money will be refunded</p> <p>On Friday 5th August 2016 the bakkie got stuck on the road again, Tata Assist towed the vehicle to the workshop in Boksburg.</p> <p>On 8 August Tata Customer Care Service called and said they are sending 2 technicians out to see what the problem is on the vehicle.</p> <p>We did not hear anything about Tata until the 15th August 2016 then Customer Care phoned only to obtain VIN number.</p> <p>Up to today we did not hear anything again for no one, not from Customer Care or the Worshop as yet.</p>
