vaal TATA doesn't wanna refund

my uncle was interested in buying a truck as he had a potential contract to use that truck. When he got to vaal TATA and spotted one he spokevto the sales rep Johan who said the truck only has a starter problem which they can fix. The following day he made a deposit with the promise that all will be fine, when he went back again to test drive the truck they said the keys are not available, the third time the truck wouldn't start, this all in november and then in december they went on holiday. the truck cost R95 000 and his paid R70 000 and he still doesn't have the truck and as a result lost his contract caused by the dealers delay so he has no use for the truck anymore. Now he needs his money back but they telling him he must wait for truck to be sold, he isn't working and its been 3 months how is he suppose to feed his family
