Used car sold as new.
My name is Janine Naidoo(Hendricks) and I went under debt review and was unable to pay my instalment and was sent a summons to say my car would be repossessed. I saw the documentation and the Natis documents show that the car was previously in Gauteng and purchased in April of 2008 and I purchased it in October 2008. I was charged for central locking and smash and grab tinting including a tracker. I was never aware that this was a car that was previously owed. Yet the car was sold to me as Brand new. The documentation states it was new from the dealership but the Natis documentation received with the summons shows that this was not the case. I would like to know how a breach of contract works as they still want me to pay over a hundred thousand rand yet I already paid over sixty thousand Rand. I could not believe my eyes and now got an email to state that ABSA their client wishes them to go ahead with the repossession of my vehicle. My ID number is ***. I need clarity on how a used car gets sold as a new car while Absa is aware that the car was already registered to someone else in Gauteng and I live in Cape Town.
