******** Peanalty of R36 140.62 charged by ABSA Home Loans to be refunded, with interest, to LP Wessels

<p>On Thu 2016/05/26 09:12 AM I sent the folowing e-mail to ABSA Home Loans at ********** <p>House in the Market - ABSA ********** 405</p> <p>I am putting my house belonging to Strubenkop Investments (Pty) Ltd *** in the market.</p> <p>I wish to hereby serve the 90 days notice of cancellation of the loan ********** 405, should the property be sold.</p> <p> </p> <p>On registration to the new owner on about 25 January 2017 of the property I received a penalty of R36 140.62 from ABSA Home Loans for cancelling the home loan.</p> <p> </p> <p>On Fri 2017/02/17 09:29 AM I sent to ABSA Home Loans:</p> <p>Please send me the Terms and Conditions that I personally signed when taking out the loan that you are allowed to charge me R36 140.62 on account ********** 405 for the reasons you put forward. </p> <p>Should you not have such a document, kindly please deposit with immediate effect the amount of R36 140.62 plus interest.</p> <p> </p> <p>On Mon 2017/02/20 03:38 PM I received from ABSA Home Loans:</p> <p>Absa home loan ********** 405 R36140.62 was charged as an Early termination fee. You did not give ABSA 90 days prior notice of your intention to cancel your mortgage loan as stated in your Mortgage Loan Agreement. We charged you the pro-rata fee from date of cancellation to date the 90 days would have expired (the attorney cancellation request on 4/1/2017 served as the first date of 90 days as no prior notice was given - expired then on 3/4/2017 Bond cancelled 25/1/2017) Please request a copy of your Mortgage Loan Agreement, Adendum to agreement from ********** <p> </p> <p>On Mon 2017/02/20 04:19 PM I sent the following e-mail to ABSA:</p> <p>Please note:</p> <p>I had given notice that I was going to cancel my home loan on Thu 2016/05/26 09:12 AM which is more than 90 days notice.<br />You have not supp**** me with the Terms and Conditions that I personally signed when taking out the loan that you are allowed to charge me R36 140.62 on account ********** 405 for the reasons you put forward.<br />Kindly please deposit, with immediate effect, the amount of R36 140.62 plus interest.</p> <p> </p> <p>I have not had a reply from ABSA as yet.</p>
