SECTION 57: HAVE TO PAY ANOTHER 20 YEARS!

On the 15 December my house was transferred onto my name by means of Section 57. I was ensured that I would only pay the remaining 9 years and 8 months left on the bond when my ex-husband's 50% was transferred onto my name. Ericka at Absa stated that its a \new\" bond whereas it is merely an amendment and that I must pay 20 years. I am of the view that I cannot pay 31 years on a bond (11 years already paid off) when the remaining term is 9 years and a few months. I have approached the attorneys who assisted me with the transfer and I was referred back to Ericka who stated that the time period cannot be amended. This is not a new bond! I am of the view that Absa has treated me unfairly as a client and expect the time period to be rectified as a matter of urgency as I cannot pay another 20 years on a bond with interest re-calculated as I am being severely disadvantaged. A section 57 is a mere amendment even if the bond account number has changed, NOT a new bond. I would like Absa to rectify this matter immediately or else I will have to seek legal recourse. The old bond account nr was *** with a remaining term of 9 years and 8 months as at December 2015. This is unacceptable"

I still have not had a valid response for this problem. Matter is being swept under the carpet!

The matter was resolved after one year of constant "fighting for my rights" and term amended.

The interest rate on the bond was increased and should remain the same. It needs to be amended from 2015 to date.

The interest rate on the home loan account was prime minus 2% but this was incorrectly amended as well. Kindly backdate this interest 2015 and recalculate the repayment outstanding on my home loan account.
