The front boundary wall of my home fell over on 23 Feb 2015. ABSA Insurance & their Complaints Resolution Committee are refusing to honour the claim & are basing their rejection on the findings of their \expert"assessor/engineer. The 2 main reasons for the refusal to pay are that the wall was not built as per 2011 regulations and that the close proximity of the tree to the wall contributed to a gradual leaning and eventual collapse.

The wall & tree were in the same place & condition as they were when we bought the house in 2003. In that time 3 ABSA assessors have valued the property - no mention was made about the possible problem.

How I can be held responsible for the workmanship of a wall built prior to purchase 8 years before the regulations were amended?

The contractor which I appointed to rebuild the wall inspected the foundations & found NO DAMAGE whatsoever. The new wall has been built on the existing foundations.

All ABSA can do is hide behind their \""terms"
