Prescribed debt
This bank is trying to collect debt that has prescribed.
The person who handled the case with ref: C-**********0 is Lindiwe.
Its strange to me that this person has no clue what they are talking about but is assigned to assist me?
She said that "A letter of demand does interrupt prescription as the Bank is making you aware of the outstanding debt on the account"
According to the NCA only a summons or acknowledgement of debt can interrupt prescription.
I have contacted the Ombudsman for banking and made a case with them for assistance.
They say that when the vehicle was sold on auction the money was paid on my account as this is acknowledgment of debt, BUT EVEN THAT HAPPENED 3 YEARS AGO. no summons was issued for this debt for almost 6 years.
You cannot take any legal action because the debt is prescribed already but still you choose to hold my ITC hostage.
Pathetic!!!! People who are assigned to assist with these matters have no clue how to handle it and just responds with big words.
