My mother has been under debt review since 2***, in the debt review application included her Absa Credit Card.
In June 2019, my mother started asking for paid up letters form all the respondents on her debt review order as she want to get a clearance certificate.
Absa sent her a letter in regards to the credit card stating the case has been closed.
After she made a further inquiry as the email receive is not sufficient, they started harassing her saying there is still an outstanding amount of R 7000.00 on the credit card, this card has not been used in 7 years, it was destroyed when the debt review order was granted.
My paid the amount due on the debt review order to the debt collectors as arranged and were under the impression this amount has been settled.
So in accordance to the law, you are not able to claim any debt outstanding after 3 years, except if the person acknowledged that they owe the money.
We have made NO SUCH ACKNOWLEDGEMENT.
She has since been handed over to 2 different attorneys acting on ABSA's behalf. Ourselves and our attorney has asked them via telephone and email to provide us with the a statement reflecting the last payment or purchase but they are unable, alternatively not willing to assist us.
I have read an article where they state that this is an ongoing epidemic in South Africa where numerous banks wait the 3 years, charges you interest, never informing you of the outstanding debt and then they call you saying you owe them this amount.
Absa has had my moms information available the whole as her car is financed through them, and they never said a peep.
We are 4 months later and no statement has received.
