Money transfered to wrong account by Absa consultant -6months later nothing resolved!!

On January 2018 my husband wanted his money from his savings account at Absa after he got retrenched. We went to the bank at Absa Piet Retief -Mpumalanga for a 30 days notice because we needed to pay bills as it was January. A consultant helped us to transfer the money from the Absa savings account -to Capitec bank savings account. We then had an emergency that required money ASAP so we decided to cancel the 30 days notice and get the penalty charges for early realise of the funds. When we got to the bank we were told to go do an affidavit for them to cancel the 30 days notice. We went to the police station and got the affidavit and then they gave us R2000 only of the R40 000 and told us the rest will be deposited the following week as the 30 days notice was almost due.

To our surprise on the day that was said the money will come through there was no money in the Capitec Bank account. We went to Absa to inquire only to find the consultant sent the money to the wrong account. Mind you the accounts were linked as he made monthly transfer from Capitec account -to his ABSA account. The whole amount was incorrectly sent to another person. We were then told to wait 2 weeks they are investigating the matter . Our bills and credit scores are ruined as the money was suppose to pay school fees and many other bills. Its been 6 months ABSA has done nothing as they have not laid any charges to anyone on the matter. Can we sue ABSA ? or must we go to Ombudsman? Because the consultant that made the error is still there employed and we are suffering. To any one who wants to have a saving account with them be very careful. The money which was suppose to rescue our family on a rainy days was given to someone out there for free!!!!!
