Misleading information and harrassment

ABSA Credit Card Division & Anthony Richards & Associates – Harassment Despite Debt Review Status

I am extremely dissatisfied with the conduct of ABSA Bank’s Credit Card Division and their appointed attorneys, Anthony Richards & Associates.

Despite repeatedly informing both parties via email that I am currently under debt review, I continue to receive persistent emails and telephone calls regarding my overdue ABSA credit card account. My debt review status is well documented, yet this information appears to be ignored.

To make matters worse, during a telephone conversation today, the consultant advised me that if I made a payment towards the ABSA credit card account, they could “get me out of debt review.” This statement is misleading and factually incorrect. Debt review is governed by the National Credit Act (NCA), and neither ABSA nor its attorneys can simply remove a consumer from debt review based on a payment being made towards a single account.

As a consumer under debt review, I am afforded specific protections under the National Credit Act and National Credit Regulations. The continued contact, pressure, and misleading information being provided raise serious concerns regarding compliance with these regulations.

I hereby request that ABSA and Anthony Richards & Associates immediately cease all direct collection attempts and ensure that all communication regarding this account is handled in accordance with the debt review process and applicable legislation.

Consumers under debt review deserve to be treated fairly, lawfully, and with respect—not subjected to ongoing harassment and misinformation.
