MASSIVE AND URGENT COMPLAINT AGAINST ABSA!!!.

Good day,

Let me make sure that you understand what is happening here as it seems as if you seem to think that this is not an extremely serious issue of which it is .For whatever reason ABSA Trust decided to replace Mphoyabohlokoa Netshirembe with this person, Lindokuhle Mlambo as the Late Estate Administrator and apparently, he is the third person as an administrator with ABSA Trust.He called me on ABSA's recorded line on the 10th of this month,June 2021 to firstly inform me that he is 'taking over' as the latest person to be the Late Estate Administrator as Mpho is not there anymore,there was some other white man who took over as administrator and now it is him.And more importantly and secondly,he called me for the fact that AIMS wanted to release the R78 000.00 but they wanted the latest 2017 ID document for my late mother to be verified and confirmed first by the Home Affairs Department.I asked him very many questions about this AIMS process and how it is going to work and it's time frames.He told me on the RECORDED LINE that he called me with that immediately that ABSA's AIMS gets the ID document verification and confirmation then they will then proceed to release these funds to him in my mother's late estate and then he will then proceed to pay the AIMS shared money to us as the heirs noted on my mother's will.I confirmed this MANY TIMES with him and he assured me that this is how it is going to work,I even asked my wife to speak to him to confirm the same details on the same RECORDED CALL.

As a consequence of the initial advise that I was given by ABSA's employee there has been several emails that were sent between myself and the AIMS representative Mapaseka Molala with Lindokuhle Mlambo as the administrator copied in the email whilst I was dealing with Home Affairs officials to give the verification and confirmation document for my late mother's ID as per how I was instructed by your representative Lindokuhle Mlambo as ABSA.After I struggled to get the Home Affairs ID confirmation letter sent to me after having have struggled immensely to get it and even Mapaseka Molala as it has been indicated knows the lengths that I went to get this letter as Home Affairs were very reluctant to give such a document,I even asked her to intervene at some point to speak to the Home Affairs official as I was under the impression that seeing I was told that once I get this sorted out we can then get this money from AIMS.Lindokuhle even told me of the turn around times of AIMS to release the money which is five working days from the time that they received the verification document,ALL THIS IS ON THE RECORDED LINE.

Remember that I never called Lindokuhle Mlambo,HE CALLED ME,I never even knew that he even existed till he called and told me who he is and the fact that I must do this Home Affairs verification and the ABSA would pay this money.He wasn't forced or convinced or led to say everything that he did to me,the advice that he gave to me,the promises that he made to me.The challenge arose when he called me last week Thursday to try and tell me that went back into my mother's late estate file and found out that after he advised as he did the first time on the 10th of June 2021 where he also introduced himself as the new administrator, that he after AIMS authorizes and sends the paid funds to my mother's late estate that HE WILL NOT BE ABLE TO PAY THE FULL AMOUNT AS HE INITIALLY ADVISED AND CONFIRMED NUMEROUS TIMES IN THE RECORDED LINE citing the same reason.I immediately got upset because he was reneging from what he said officially as ABSA's representative,he MISLED ME as a client as a client,that he misinformed me.I made sure he knew all of that,ALL THIS IS ON THE RECORDED LINE.Itold him that seeing that he is not going to pay the whole amount like he stated that he would,I wanted to know what partial amount would then be paid to us as he said that we won't get the whole AIMS R78 000.00 distributed as per will prescripts among the heirs as he initially said.In more clearer terms I am saying that he called me again last week Thursday to tell me that ABSA Trust is going to pay partially the AIMS money to the heirs ON THE RECORDED LINE.Once again,I I didn't call him,he called me to ADVISE ME of that change in payment from ABSA as ABSA's representative.After this call ,I sent him an email to find out the partial amounts to be paid and he has not come back to answer me on that.I subsequently sent him another email to get feedback and he didn't respond ,all this is after I EMPHASIZED AND REITERATED strongly to him in the initial call that he made to me that I need feedback, prompt and proper feedback,all of this is on THE RECORDED PHONE CALL TO ME.

In the email below you say that you addressed this with Lindokuhle Mlambo.There is is nothing that you addressed with him,you just spoke to him and now are trying to spin this MASSIVE MISTAKE AND BLUNDER of MISLEADING a me as a client deliberately,of giving me INCORRECT ADVISE on purpose thinking that ABSA can just renege at any time and for any reason.The secon correction is the fact that Lindokuhle Mlambo never addressed the issue of the predeceased estate,he was was trying to tell me that because he only found out about my father's estate after he decided to try and do his job properly and realised after the fact that he misinformed and misled me regarding AIMS that he needed to reserve a portion of the AIMS money.All this was conceded by him repeatedly and he on THE RECORDED CALL on Thursday said that he gave me INCORRECCT ADVISE,that he was wrong to say that ABSA would pay the whole amount but rather ABSA would be paying the partial amounts. This 3rd individual ,Lindokuhle Mlambo that you have placed as the new administrator should be qualified to handle and deal with clients but it seems the incompetence with you people knows no bounds.If he is doing this,he is probably not qualified.He has to give true ,factual and accurate advice and that goes along to any Financial Services Provider just like it is encumbent on ABSA.Even when he calls me,it is as if he is calling in his own personal capacity, he doesn't inform me that ALL CALLS ARE RECORDED AND CAN BE MADE AVAILABLE UPON YOUR REQUEST (as client),as a client i need to be informed of that ,AS IT IS MY RIGHT TO KNOW THAT.ABSA through its representatis like Lindokuhle Mlambo and even yourself act as if you above any regulations by F.A.I.S Act and related legislation regarding the treatment with clients and more especially ,giving advise to clients.In section 1 of FAIS, "advice" means "any recommendation, guidance or proposal of a financial nature furnished by any means or medium to a client in respect of purchasing any financial product, or in respect of the investment in any financial product or on the conclusion of any other transaction including a loan or cession aimed at the incurring of any liability or the acquisition of any right or benefit in respect of any financial product or the variation of any term or condition applying to a financial product, on the replacement of any such product, or on the termination of any purchase of investment in any such product and irrespective of whether or not such advice is furnished in the course of or incidental to financial planning in connection with the affairs of the client or results in any such purchase, investment, transaction variation, replacement or termination, as the case may be, being affected". Advice in terms of FAIS is rendered by a financial services provider who is defined as "any person who as a regular feature of the business of such person furnishes advice, or furnishes advice and any intermediary service, or renders intermediary service".Similarly, the Financial Sector Regulation Act, 2017 defines "financial service" to include among others, providing advice, recommendations or guidance in relation to a financial product, a foreign financial product, a financial instrument or a foreign financial instrument. No TCF policies observed whereas it should be at the heart of doing ABSA's business.

We hereby confirm that the AIMS investment has already been taken into account and reflected as an asset in the Liquidation and Distribution Account. It therefore forms part of the funds reserved in the cash statement but was yet to be collected. Delays were unfortunately experienced due to the copy of the later issued identity document of the deceased required by AIMS to complete the redemption process.

The content of your email was addressed with Mr Mlambo who advised that he indicated to yourself that funds could be paid out once everything is in place on the file. Since no progress has been made with the estate of the late Mr SB Kekana that enables us to finalise the estate of Mrs Kekana, we are not in a position to effect any further payments, as previously communicated.

I trust you are well.I spoke Vanya concerning this AIMS funds money that I discussed with Lindokuhle Mlambo that it will be distributed to us as the heirs after it has been captured and authorized and sent to the late estate for Lindokuhle Mlambo to pay us as the heirs as he said he will regarding this AIMS money, several times.Vanya said that he will speak to you so that you assist with this.You haven't said anything,I also copied in Mareese Joseph as well in the email that I sent to Lindokuhle Mlambo this morning attempting to understand what is going on here.Both Mareese Joseph and Lindokuhle Mlambo haven't said responded or acknowledged my emails.

I am really struggling to understand why do you treat your customers like this?!Or is this kind treatment only reserved for me?!Just like I stressed to Lindokuhle Mlambo that the most important factor here especially for me as a client is feedback,prompt and proper feedback.I am consistently getting the opposite of that.These AIMS funds,this money ,is inexplicably important to me and my family,I have expressed this in endless ways.If I need to beg or to grovel or any other action to get assistance and feedback please tell me and I shall do it,as expecting you through normal client-FSP discourse and amicable & reasonable request to get service,clearly that doesn't work.So please tell me if I need to grovel or beg,or what you prefer and I shall do it.

What is happening here with Lindokuhle Mlambo and his boss who is Mareese Joseph is breathtakingly upsetting.It is the first time I have ever encountered such a thing, especially with such big company like ABSA.

I trust you are well.I spoke Lindokuhle Mlambo on the 10th of June 2021 where he proceeded to inform me of the AIMS R78 000.00 that was required to be released by them in order to be paid to the heirs.In the initial phone call that is recordedand the subsequent ones made to me I made sure that I spoke to him at length and I asked him as to the procedure to be followed.He told me that I must get confirmation if my late mother's 2007 issued ID document as it is AIMS' due diligence requirement before they authorized and paid the AIMS share funds into the late estate so that he (Lindokuhle Mlambo) would in that same instance/immediately transfer to all the eligible heirs their share as per the prescripts of the will.Once again I need to emphasize and stress strongly the fact that I asked very many questions regarding this process and the money and he made sure that I understand that once AIMS gets this verification document from the Home Affairs department that I needed to get,they will transfer the funds to the late estate and he will then pay them to us as the heirs within their respective percentages as laid out in the will,he said specifically the whole R78 000.00 that came from AIMS would be paid out to us.Now on Thursday last week on the 17th he then called me again to try and tell me that he went back to 'the file' and just found out that he cannot pay the whole amount,he needs to keep/reserve some of the funds that come from AIMS.

I specifically told him at that moment on Thursday that if he is a representative of ABSA,he cannot in any shape,form or manner make pronouncement or matter of fact statements to clients only for him to renege on what he said initially,not coerced by no one and making statements as a representative of ABSA to clients such as myself.I told him that he is giving me incorrect advice and that is misleading me as a client as what we agreed upon from what he promised as a representative of ABSA is all of a sudden different along the way.I then asked him to go back and ascertain the amount that will be paid out to us when the AIMS funds are released to the late estate and come back to me with a response so that I am aware of what is to come as this money that he is making arbitrary decisions on, reneging and changing his tune on is our money and we depend on it.The thing that bothers me acutely is the fact that even though I reiterated and emphasized the fact that above all things I value and want is feedback, Lindokuhle Mlambo as the new administrator still even after I told him that I want an answer to home much are going to be getting from our AIMS money,he still hasn't responded till now.I feel like we are taken for fools and this kind of regard is tailor made only for us where representatives of ABSA can make whatever pronouncement and give whatever advice and then renege whenever they want and for whatever reason they see fit regardless of the impact it has on their clients.I also copied Mareese Joseph on the email this morning and I haven't even received an acknowledgement or a response from her as well which is very alarming as she is clearly the executor,she is not on leave otherwise her out of office notification would indicate that,so what I can deduce is that she found it fit to just ignore me.

Below is indication given by the AIMS representative,Mapaseka Molala that these funds are released to Lindokuhle Mlambo and the late estate,this guy hasn't come back to me as I repeatedly asked for him to do regarding this money and I was specifically and deliberate in making sure that he understands that we need that money extremely desperately,that I am unemployed and that is how I am able to provide for my family.This situation of hardship is not something that is emanating from this moment,I have had situations where I alerted and informed you of this terrible and unbearable hardship we are going through especially after my mother passed away.I don't understand why this person has decided to do this to us,why he didn't just do his job thoroughly and efficiently at first go as he is dealing with people's lives and livelihoods.I would assume that he is in that position as he should be qualified to be in that position and act appropriately in that position.So this I take extremely personally, especially if I did what I had to do to get that confirmation as I struggled a lot to get it even though I have no resources from the reluctant Home Affairs officials in order to get what we were promised.I would have less of a problem if he after he has thoroughly read and understood the file,told me of what I had to do in order to assist to complete the AIMS process and the partial amounts that he would need to reserve,and not after the fact when he should rather be preparing to pay us our money.

I was promised that AIMS money will be paid,I need for it to be paid as AIMS has released it.At this point I also want to understand that if ABSA has after the fact of Lindokuhle Mlambo's initial pronouncements has decide to adjust downwards the amounts paid to the heirs in order to reserve some of the AIMS funds for the stated reasons,I want to know what amount is going to be paid.I want to what time will it be paid or released to us as I was told that immediately as the funds are authorized and signed off to the late estate then they will be paid immediately.I really need to get immediate and urgent attention on this matter,this is not on and it is not right.At least he got paid on the 20th as he is working for the bank,what do we have,he can take care of his family whilst we suffer unnecessarily.People's lives are being affected here.

I need to know how much im getting and i need to get confirmation if you have released whatever amount that needs to be received by me.I have very clearly explained to you how much I need that money,I need it to paid as you immediately said and promised in several recorded calls you made to me.I told you that me and my family are completely reliant ,I am unemployed and I as a husband and father am re**** upon by my family.That money is extremely important to us,it inexplicably crucial for our survival and I would appreciate you doing what you promised repeatedly to me when we were discussing this AIMS money in the several phone calls when you called.
