forced into a situation on YOUR advice!

Good day I really hope you take the time and some effort to READ this, as this is what you have caused. I would like to thank you for kicking me on the streets and causing me to lose my home and job. Recently I app**** for vehicle finance, I was declined, not due to score (that time) but due to “liability of income”. Meaning, they need prove of where my income comes from. So I submitted 6 months payslips and was recommended to apply as “self-employed”, still declined. I was then requested to send my employment contract, which I did. Yet that was not good enough as the contract is a yearly renewal. I was then informed that I should try get a letter of employment, which I did. It indicated salary and employment term. YET, this still was not good enough as yet again I was declined, but this time I was told that “due to the way your company pays you (innervation card to ATM to capitec), I now had to deposit money into another account so that I can eft to my capitec so that is seems more legit. Legit? I have a letterhead from my employer (names not mentioned) which is one of the largest companies in south Africa. How more Legit must it be!! SO, what baffles me is that the problem is basically how I get my wages. What difference does it make when every month money reflects into my capitec account (which is what you base you credit on). Frankly, It is no concern to you how the money gets into my account, but only to know if there is enough money to pay your bill at the end of the day, right! Let me explain to you how wages are paid since you are adamant in knowing. due to my work (who I have been employed for 7 years) pays us through an Innervation cash incentive card. Every month on the 15th, monies owing to me (by the company) are paid to this innervation account, I then draw the money at an atm and deposit it into my capitec account for an income trail. Then I pay all my bills manually, which is about the 16 – 18 of each month, just so they are paid. Remainder is mine to spend!! Even after all this. You still do not want to give me vehicle finance, even though I have app**** for cars between 78k up to 389k. I am no longer able to apply for any finance as my credit score is now to low due to the many times trying and being advised differently on each decline. My job requires me to be on the road, i have equipment that needs to be taken to sites in order to do my job, so that I can earn a salary and pay my bills. Now that you refuse to finance me and due to your faulty advise, I am not forced to sit at home, lose my job and my home. So I will accept this fate, but not without a fight. In the next few days I will be Uber-ing to The South African human right commission in Johannesburg, so that they can investigate and explore my human rights on this matter. I will not stop until my forceful situation you put me in has been exploited. Thank you for messing my life up an all because I took YOUR advice!!

After being contacted by Basani Hlungwane from head office by email, I was informed that she will be my ‘dedicated contact person for this matter’ and ‘your concerns are very important to us and I will immediately investigate the matter for you and provide you with update or feedback by no later than end of day 25 November 2020’. I then rep**** back to her email explain the whole situation and urgency of the matter. I soon received the following:

Summary of complaint:

With reference to the Hellopeter posting received dated the 16 November 2020 regarding declined vehicle finance.

Our response:

The matter was expedited to the mandated officials at vehicle finance for a review and we can confirm that the application has been declined.
Your application for a vehicle finance with Absa does not meet the Bank’s minimum lending requirements.

We appreciate the time you took to communicate with us and extend our unconditional apology for the inconvenience that may have been caused.

Our office is therefore closing the case.)

I then asked for an explanation to what is the ‘ bank’s minimum lending requirements’, her response was

(Hi Warren,

We do not disclose the details of our credit scoring criteria however, the consultant would request information and or supporting documentation for the credit scoring and assessment.

Your application for vehicle finance was done or processed by different institution and all declined 5 as per our record, was unsuccessful.

Sorry Absa cannot assist with the facility you app**** for.)

I’m I not the client, am I not allowed to get an explanation on my own personal information? all i did was cut out the middle man (dealership) and came straight to absa!!

the 5 applications were because of absa advising me of what they required at the time but giving me hope at the same time only to decline me (as explained on the first hello peter post). its like you have one of those 8 ball future teller ***** and each application you shake the ball too reveal your answer.lol!!!!

Denied from finance, now denied from information. Am I going insane here as it sounds unreasonable!!!

They just don’t care!

oh well, it’s the next escalation level up.

UPDATE: i now receive (which is possibly the last response) the following:

(Hi Warren, There are many things that the credit scoring assess and one of the reasons your application was not successful is that:The finance amount app**** for exceeds the market value of the asset and therefore does not meet the Bank's minimum lending criteria.The age of the asset exceeds the maximum age allowed in terms of the Bank's criteria. is some form a joke, first i was declined for 'liability of income' to now "maximum age of asset'.
surely someone out there can make sense of all this. i have ONLY being applying for models from 2015 and up.

THE consumer rights protection act states, under 'elements acts' the following :

" Elements of the Act Consumer rights protected The Act entrenches a number of fundamental rights of consumers in the credit market, including protection against ************** in credit granting, the right to be given reasons for credit being refused, or discontinued, the right to information relating to the agreement, in an official language, and in plain and understandable language, and the right to choose whether to receive certain documents electronically or in paper copy. "

THIS is ************** in credit granting for sure.
