ESTATE LATE LBG NDABANDABA
Kindly assist on the following matter:
Absa Trust has power of attorney to finalise our Late Father's Estate. As the executor of the Estate I am currently abroad and there is still an amount outstanding on the municipality account and my siblings have been trying to resolve the matter but due to financial constraints, we have not been able to raise the funds to make an arrangement or pay the amount in full.
Marcia Duimpies and Lydia Truter assisted with paying all our late Father's outstanding accounts but the municipality account was not settled and we were informed that it must be paid by the occupants of the property.
On querying the outstanding amount my siblings with the help of the plumber discovered that there were water pipes that were connected *******ly on the property.They did alert the municipality officials and the municipality officials confirmed that the monthly bill was too high for a household but informed us that we still had to make arrangements to pay and requested 10% of the outstanding amount.
They also explained to us that if the error was on their side they would have assisted with reducing the amount.
I do understand that we have a duty and responsibility to pay the outstanding amount so that our late Father's Estate can be finalised.
I would like find out about the escalation process at Absa because there was an email sent to all the siblings by Mr Benjamin Van Der Westhuyzen giving us an ultimatum to settle the outstanding amount and also requesting that I resign as an executor if the amount is not paid in full but the email did not come from Marcia Duimpies or Lydia Truter.
My concern with the email received is that Mr Benjamin Van Der Westhuyzen did not know who the executor of the Estate was and was requesting the name from the family members.
How can parties working on the same matter not have all the information on the Estate?
I can resign as an executor but would really like a step by step process on the way forward and also for Mr Benjamin Van Der Westhuyzen to explain how the power of attorney given to Absa Trust will be impacted by the resignation.
I know that Absa Bank put the customer first in all they do and would really appreciate if Mr Benjamin Van Der Westhuyzen can give us more options as we did pay Absa Trust to handle our late Father's Estate and if we part ways with Absa, we do so in a professional manner.
It is not going to be easy to raise the amount between the 18th of September and the 30th of September 2023. I would really appreciate your expertise on the matter.
