DISGUSTED WITH ABSA BANK

Hi, on 21 January 2024 after liaising directly with the Seller for some time we signed an Offer To Purchase on a Deceased Estate. The Seller requested us to contact his friend David Reid from Remax All Stars, Primrose which we queried why should we deal with him and pay commission. The Seller then deleted all his messages where he committed to selling the property to us privately. We signed at the Attorney's with Sonja Posthumus at Joubert Scholtz Inc. in Association with Denga Inc. on 26/02/2024 and raised the commission matter with all our proof again being "Attorney's". Sonja stated it needed to be discussed with the Executor Lucy Legodi from Absa Bank. We then received an email that Lucy dismissed the matter. We requested Lucy's contact details which she needed to first obtain permission to provide us with Lucy's contact details which Sonja later did. Again all proof and of messages as well as the property law which states the Agent has to prove that he was the cause of sale and introduced us to the property in order to claim commission. Lucy stated she will discuss it with Leonard Stoop, the Deceased brother and revert back to us. After awaiting 3 days, I had to follow up with Lucy again and then received an email that the Seller has decided to cancel the deal. I contacted an attorney as it is legally binding documents and the attorney requested myself to find out from Lucy on what grounds the deal was canceled. Lucy stated that she is also an attorney and the Seller does not have to give reasons. Lucy also stated that herself being the Executor has not signed the documentation so they are not bound yet the Seller signed the Offer to Purchase and she feels he's not bound and can cancel as he wishes after being over a month. I have seen Deceased Estates where the Executor/ Trustees went against the Deceased Will due to it not aligning with the law. However, in this case Lucy being an attorney and Executor, the conveyancing attorney's as well as Remax All Stars all having legal knowledge goes against the law instead of advising the Seller, they seem to be doing as he states ********ly. It is PATHETIC that Absa Bank, the conveyancing attorney's and Remax legally clued up and well known goes against the law and takes instructions from the Seller who is clearly helping his friend to get paid over R45 000 for doing nothing. I'm disgusted at all parties concerned and have never seen another Bank Estate Executor Lucy Legodi go against the law instead of advising the Seller. I hope clients who have and consider Absa as their future Estate/ Trust reconsider as clearly your hard earned money and assets cannot even be trusted with Absa.
