Absa Vehicle Finance - E/Late PS Miya - ***1 & ***2

In 2023 around July/August my husband bought 2 taxis and was financed by ABSA. Unfortunately he passed away on the 24th Sept 2023 due to unnatural cause, after his funeral i contacted Absa to inform them about his passing, the consultant advised me to submit the required documents in order for me to access his account. I went to apply for a Letter of Executorship as we were married customarily and did not have a marriage certificate, After getting a Letter of Executorship I submitted all the documents required to the bank for them to access his accounts. Thereafter the bank sent me Hollard Insurance documents to complete and submit back to the bank as my husband took Life Insurance with Hollard when he purchased the vehicles. Few weeks later I received an email stating that the claim was declined as Hollard never received the first instalment of the insurance but my husband passed away before the due date of the first instalment.

I then communicated with Absa that I will continue paying the vehicles instalments since the insurance declined the claim. The Feedback I received from Absa is that I need to settle all the outstanding monies for the vehicles if not I must provide them with the address where the vehicles are located they then will come fetch the vehicles. I tried to communicate with the consultant I even went to Absa Deceased Estate offices in Auckland Park where I met with Caroline Simms (Department Manager), she mentioned that she will send my details to their sales departments to apply for refinance but was never provided with feedback.

I believe that as I submitted a Letter of Executorship i will be given an opportunity to carry on paying for the vehicles. The consultant told me that i can pay the instalments but they are not going to refund me should they come repossess the vehicles. I believe that i was treated unfairly by Absa as I know someone with a similar case as mine but she was given an opportunity to carry on paying for the vehicle after his husband had passed on.
