ABSA Vehicle Finance CPA
This is a summary of my complaint. The rating would be lower if possible. I purchased a Jeep SRT8 from a dealership (Dadzos Investments in Benoni) through ABSA Vehicle Finance on the 7th April 2022. They delivered the vehicle in my absence on the 12th April after my return to Lagos Nigeria where I work. There was a warning on the dash for the 4WD System and the traction control failure. As this is a performance vehicle I notified the dealership and they said I can bring the vehicle back in 10 weeks when I return from Nigeria for my break. I had the vehicle diagnosed at Jeep Boksburg and identified defects which would cost 1 third the purchase price to repair. (Over R100,000 YES one hundred thousand rand) After pleas to the dealership, broken promises and lies we decided to request for the purchase to be cancelled by ABSA (the title holder) under The Consumer Protection Act 68 of 2008 (CPA) I duly sent a request to ABSA VF through my lawyers on the 6th July as I have not had the use of the vehicle since the day I purchased it. ABSA have not bothered to even acknowledge receipt of the letter up to and including the deadline of 20th July, 3 full weeks later. I suppose because I am just a number on a contract, ABSA does not feel the need to attend to my protection as a consumer. The vehicle is STILL defective and at the Bedfordview Jeep workshop and there is zero urgency to assist from ABSA or the dealership. So this is how we are expected to be dealt with by one of the largest banks in SA. Perhaps media attention will bring some reaction from ABSA. The options in the consumer act are clear: REPAIR REPLACE REFUND The OEM feels the car is unsafe and the repairs are not being effected. The replacement vehicle I would have accepted is no longer available so the final REFUND option is all that is left. Will ABSA stand by their ethical responsibility??? It seems this will not happen.
