I have been dealing with Absa for months on a vehicle finance account that prescribed . My vehicle finance account prescribed due to negligence of Absa staff in 2019 but when I advised them of the prescription and they came with a lot of excuses. They went to court and app**** for judgement stating that I owed them money which they knew was incorrect. I engaged with them again and told them that they are reviving debt which is contrary to the National Credit Act and the Prescription Act. They even came back to me on email,l Johan Geyer on 18 June 2020 stating debt will be written off and they have no claim on this debt. to my surprise yesterday 16 October 2020 the repossed the car on the judgement they obtained on a claim of outstanding debt. As per law it would revive debt if I returned the vehicle admitting to debt and therefore would not do it. They think I am stupid and they had no claim to reposses the vehicle due to no debt. So what did they do they broke the laws by collecting the vehicle with all it`s contents which they have no right too. They took my wallet with money, jewellery and personal items as well. I am sure that this does not belong to them and surely they can be classified as *******. Now it is not a civil matter but a ******** matter as well. If this is how a bank operates please close them down.
